It depends on the state. In this state, Washington, if the apartment looked abandoned (left empty for 15 days or more) the landlord could do that. He could also do that for non-payment of rent, but there's a whole series of notices and servings and court procedures that he would have to follow. We do not have enough information to answer your question accurately.

Its going to depend on where you are living but in CA, the landlord can do that but that usually done after the sheriff shows up at your door on a pre-disclosed date. If the eviction process has gotten to that point, you should know when you need to be out. If you did not heed these warnings and the sheriff shows up to evict you, you'll have about 15 minutes to take what you can grab and vacate the property. You have approximately 15 days to make arrangements to get your stuff out. The landlord can also pay to have your property sent to a storage unit. If thats the case, you will need to pay for the storage and moving expenses in order to get your stuff out. If you do not claim your property within that amount of time, the landlord can auction your property off to recoup the cost of storage and moving.

I have had to do this a few times to get bad tenants out of my properties. In one case they tried to sue me but they didn't have a legal leg to stand on and lost since I gave them multiple opportunities to recover thier property but they never showed up.

Landlords take no pleasure in doing this to tenants but sometimes we have no choice.

Tenants are usually protected against those kinds of actions by landlords. Look up the Landlord-Tenant Act of your State and also refer to your lease. You may want to go to small claims court to address this issue.
