I have a month by month lease. It says there is not allowed overnight guess. My brother is came to visit me for couple weeks. Although he comes from overseas, my lanlord said that my brother can't stay in my apartmant because he hasn't name on the lease. . Can the lanlord restrict me who can stay overnight? Actually I have a lease and as i mention that it says 'not allowed guests overnight' but he is my immediate relative. Can someone else respond my question?By the way I live in NYC. thank you.. Additional Details actually my brother is here. I can't tell him stay in a hostel but she says that. by the way I said that it's room but it's 3rd floor of the private house and I live w my roommates. i don't see why the land lord wants to be a ----..i would let him any way,,the only thing he can do is make you move,,or i would put him on the lease and that would solve every thing,,and explain to him why he stays there when he comes in,,if he cant understand that he is a grouch,,by the way.

If your lease clearly specifies 'no overnight guests', then your brother (or anyone else) cannot stay there. That he is your brother does not change the fact that he is a guest.
I'd suggest speaking with the landlord and offering to negotiate an additional fee for him staying there. Perhaps the landlord will soften and agree, if you offer the extra money and have the agreement of your other roommates for the period involved. |

If it specifically said in the lease that you signed "no overnite guests are allowed" then Im afraid that you are SOL. |

The clause was in the lease when you voluntarily signed it. You and your roommates are liable for eviction if you violate it. Simply have him stay with a friend of yours. |

You know the rules- they are not any different for family.
Your lease states "not allowed guests overnight" then you CANNOT have ANY guests overnight. PERIOD! He has to leave or you will be evicted.
This is perfectly legal. Landlords have every right to no allow any one not on the lease to stay in a rental. |

You clearly state TWICE that your month to month contract says NO overnight guests. What part of that didn't you understand when you signed and agreed to it? This is not your house, so you don't make the rules. Your landlord doesn't want anyone who is not on the contract to be there overnight, period. If that wasn't acceptable to you, you should have found a place that accepted overnight guests. |

technically no he cant stay but since you are on a month to month lease and he will be staying for a few weeks see if you can add him to the lease and then have him removed when he leaves. |

I don't know about overnight once, but there are usually clauses about other people staying for a certain amount of time. a couple of weeks might do it. |
