Estate agent is forcing me to pay a month's rent because i forgot to give a month's notice!?
it was in the contract that i needed to give a month's notice if i wanted to leave after 6 months, otherwise it would roll on month after month until i gave further notice.

but I have a valid and legitimate reason for not giving notice -

what can I do?

A contract is a contract. You must pay up. Tough. Forgetting to give a month's notice is not now and never will be, a "valid and legitimate reason" for not giving notice.

If that is what you signed up for then they have every right to insist that you do it.

A contract is a contract, and they have no reason to let you slide. Offer to pay them half; it can't hurt to try to bargain. If it means you won't get any security deposit back, then you have less leverage than if it means they'll be sending you to collections. Typically--if they're sending you to collections for the debt--they'll only recover half the money anyway. Of course, this varies state by state as laws are markedly different.

Your stuck, it is the law, especially if it is in the contract, and there is no clause for exceptions.

Write to them and explain your legitimate reason but you are in breach of contract and they may make you pay. As agents they would be breaching there contract with the landlord if they gave you his or her details sorry.

Hello Julie,

I think you will find you will have to pay the amount they are asking. The best you can hope to do it to ask them nicely if they would accept part payments from you ... say a quarter at a time... over a month or two months for reasons of extenuating circumstances. Do not withhold why you needed to take this action. If you can back what you say with statutory declarations, produce them. Give them the best possible reasons why they should be lienient with you. The reason you most likely will have to pay is that without the notice, the owner is deprived of a legitimate income as it takes time to prepare the dwelling for renting, vetting the future tenant applications etc.

I am sorry this has happened to you, but your best course of action is to appeal to their human kindness.

you still owe the rent, valid reason or not, you must give the appropriate notice

most rental contracts do not say, you must give 30 days notice unless you have a valid reason...

simple thing is valid and legitimate does not mean legal. A contract is a legal document so any reason to void it must be a legal one.

You have to pay up. It is your responsibility to give the one months notice and if for any reason you dont do that, then you adhere to the terms of the contract you signed. And your landlord will be paying the estate agent to manage this property so he should not be inconvenienced just because you "forgot". You wont forget next time though!

well, she may have you there. depending on what state/municipality you live you may not have any choice other than to pay. I would speak with her and at best try to negotiate it down.
