An eviction is not something you want.
You have 3 days before eviction is filed. If you want the eviction on your record for future landlords (who will not rent to you) or employers (who will not hire you) then you have another 10-30 days, depending on where you are.
You have 3 days to move out or pay the rent. The landlord HAS to accept the rent in those 3 days, but not once he has filed the legal charges against you. |

It depends on the state where you live. However, generally there's a 30-day notice requirement, unless rent is overdue, then the landlord can issue a 3-day eviction notice.
However, the process to actually evict someone can take much longer than that. Papers have to be filed (unlawful detainer), there's a court hearing (which can be 10-20 days after that), the sheriff gets involved. |

Generally, the tenant will get a Notice To (Pay or) Quit. It can be anywhere from 3-15 days depending on your state's landlord tenant laws.
If you do not pay or move out within the time allotted in the notice, an eviction will be filed.
In some states, even if you pay within the notice period, the landlord can continue with the eviction. The notice would be a Notice to Quit.
An eviction will seriously affect your ability to rent in the future, so it is in your best interest to move out voluntarily within the notice period.
Of course, you have the right to be evicted through the courts.
You will still owe the rent and the landlord will get a money judgment for that, which will go on your credit report.
The landlord will also get an eviction order. Generally, the court date for the eviction hearing is within a few weeks.
Once the landlord has the order, you may have an additional few days to a week for the sheriff to come set you out, depending on his schedule. |

They can move out any time up to and including when the sheriff shows up and tells them to leave. Once the sheriff shows up, however, if they are still there all their stuff will be taken out and put on the curb. How long the eviction will take varies from place to place. |

A landlord needs to send his tenant a registered letter stating the date they are to move out.. This proof that the tenant knows they have to leave by a certain time.
If by that time they do not leave then you can have the police make them leave. |
