Eviction from apt question?
I know of a person thats renting an apt. Shes single and has 2 kids in high school. Anyway, shes on a month to month rental agreement. She never signed a lease.Her landlord gave her a 2 month notice that shes going to have to move and get out. This girl says that if she has to get out and can't find anything before her time is up, she'll just stay there until she gets evicted and she won't have to pay rent. I said that she just can't live somewhere for NOTHING. She said even if the landlord brings her to court and evicts her she still won't have to pay any rent that the judge orders her to pay. I think she will have to pay her rent anyway. You can't live somewhere for free. She lives in the state of Massachusetts. Would anyone know the answer to this? Wouldn't she have to pay the rent anyway even if shes evicted?

Oh, the judge will make her pay the rent and the cost of the eviction.

She will have it on her credit, making not only renting hard, but also getting a job. Credit checks by employers is common practice, and this is just what they want to know. Is she honest or will she try to screw you? She obviously feels the she has the right to screw others and freeload. Not a good tenant and not a good employee.

The landlord will eventually get their money, via collections or garnishment.

If she lives in the apt, she will be responsible for the time she has occupied it. The landlord is generous that he gave her 60 days notice as only 30 is required.

Even if she stopped paying because she knew she was getting evicted eventually, she'd have to pay. The land lord would take her to court and the judge would rule in his favor and she'd have to pay him back.

First of all, why would you want to be friends with such a scam artist? Is this the kind of behavior she is teaching her 2 kids too? That it is ok to scam people? Nice mother and role model, very sad.

To answer your question, once the landlord takes her to court, which he will, the judge will slap a judgment on her for all the amount she owes, plus penalties, which will *drastically* damage her credit, and then she won't be able to rent any apartment in the future b/c no other landlord will rent to her. If she chooses to ignore the judgment it will just get worse from there. She will also have no references, and a low credit score. This will end up costing her far more than the amount of rent she thinks she is going to save by scamming this landlord. She will end up in a big legal mess and her credit will be severely damaged for 10 years.

Even if she stops paying chances are the Judge will award the landlord the monies owed along with court costs and possible attorney's fees, a judgment or lien will then be placed on her credit preventing her from buying a car, purchasing a home, getting any sort of loan, renting another apartment or home bottom line is it'll ruin her credit and any chances of purchasing anything or applying for credit in the future. It'll haunt her and it's honestly not worth the hassle this will cause her for many years to come. She won't get away scott free she will have to pay the money one way or another, whether all at once or via a payment plan. Either way she will pay, monetarily or credit wise.

Tell her to just find another place in the 2 months allotted to her by her LL, he was more than generous in giving her 2 months notice when legally all he is required to give is 30 days. It'll be much easier for her to find a place with no black marks on her credit than it will be once her landlord has filed eviction and won.

If she signed some kind of legal agreement, whether it be a lease or a month to month agreement, she will be liable to pay back any unpaid balances. If her landlord decides to take her to court the judge will most likely rule in his favor, but there is a chance that the landlord may just take it as a loss and not take her to court over the unpaid rent, but I wouldn't count on that! But, I would tell her that legally she is responsible for paying her rent, whether she is evicted or not.

She won't "have" to pay but there will be a judgment filed and recorded against her. It will be on her credit report and will be a major obstacle to getting any future credit, plus the judgment creditor (landlord) can then eaily get a wage garnishment to take the money out of her wages, or a bank levy to take it out of any bank account she may have.

If she gave the landlord security, she can apply it to the rent. Once she gets a court notice if the landlord takes her to court, the judge will make her pay any back rent plus court costs. There's no such thing as free rent anywhere. They'll set up a payment plan for her to repay the rent owed.

it will take at least 2 months for her to get evicted AFTER her time is up...so she better take that money that she is saving up from not paying rent and try to find another place to live. THATS if she is smart...2 kids and in high school...maybe not that smart. if she is still in high school and have 2 kids...she is elgible for subsidized rent and should be able to get a place with 2 kids from th gov...tell her to weigh her options and stop sleeping around.
