I bought a house in Belfast last year, which I rented out to a recently divorced woman. I have been very patient with her non-payment of rent, and listened to all her excuses and promises of money but have had enough now as she owes 6 months rent and now I am sure she has fed me a load of lies . How do I go about evicting her? The house is in a mess (from the outside anyway) and I will need to spend a lot of money fixing it up. If I do evict her, is there any chance I'll ever get the money she owes me or will I have to put it down to experience?
Also, is there some way that I can blacklist her to stop her doing this to someone else in my position. I'm so mad I could kill the btich but have to try really hard to keep my cool. |

First of all, getting mad is not going to get her out of the house. You risk making it tougher. The primary goal is to get the occupant out and hopefully get her to leave it in decent condition. Evictions can be expensive, and timely. I would recommend offering her cash to move. I know it sounds crazy, but hear me out. Research how much it will cost you to go through the eviction process. Usually, the reason she hasn't paid rent is that she is broke. Meet with her (if you can't do it without getting mad, have someone else do it), find out what the issue is and how much she needs to get moved. Then have a short contract written up that if she is out in ten days and the property is clean (broom swept condition), then you will cut her a check upon inspecting the property and receiving the keys. In the foreclosure business, we call this cash-for-keys. It works 9 out of 10 times. Just remember, the goal is business (get her out in the least amount of time, with the least amount of damage, and the least amount of expenses), not personal vendetta. Hope this helps. |

Are you sure you are not renting to my Niece, in New Jersey, USA? There are people that make the experience of land lord very horrible.
Add the cost of the repair and back rent to the cost of the property when you sell, the increase cost will prevent you from having to pay taxes on the gain.
I am in the USA, the eviction rules here may be different than yours. Do not - Do not let a tenant fail to pay a month's rent. If this occur have the tenant pay a month and a week the next month. If there is any excuse start the eviction. |

Gssss 6 months no rent...I wish my landlord would allow me to do that....unfortunately, if this lady got no money now, then sueing makes no sence cause she aint got nothing to give...just kick the bastard out...oops sorry i forgot we are in America even people who aint pay rent for 6 months got rights too.

You have to serve her a writ of restitution with the city courts. Then they wait about 10 days for her to come up with the $, if still no $ then you schedule the constable to come out and lock her out.
If you know where she works you can get a judgment of wage garnishment after you evict her. If you don't know where she works then you can turn her file over to a collection agency and see if they can get $ out of her, but you will have to split the money with them.
You may not want to put her on a list, because she can come back and sue you for all types of dumb stuff. But if you are well protected by business entities set up to reduce your liability, and don't mind losing some of them, then by all means go at it.
But how many people sue someone else any way?

* NEVER BELIEVE ANY RENTER NO MATTER WHAT * I know from experience, their rent is due on the 1 give a leeway until the 5th but if they don't pay start the eviction process immediatley, if they come up with the $ then cancel the eviction process. It will make them think twice before blowing all of their money before their rent. Don't second guess, just do it! |

You need legal advice. Try CAB first, you never know what thye might suggest, then find a solicitor that does the first half hour free and do a lot of research via Google.
Perhaps find a chat room?
Unfortunately, you are going to need to spend a lot of money to reclaim your house. Do it quickly though, or she might be able to get away with claiming that you did nothing for 6 months so has a right to live there rent free.... Peculiar loopholes in the law...
I do know a few unsavoury characters if you need erm, further help... ;) |

But that would require you cared about someone other than your precious self and your bank balance wouldn't it?!

I am from USA so not familiar with laws in Belfast. Just wanted you to know it wasn't nice of your tenant to take advantage of you while you tried working with her when she got behind on the rent. She should be ashamed.
In the USA there is a Landlord Tenant Office where they have Eviction papers (and advice), hopefully you have one there that can help you. I feel bad that this has to be your first experience with a rental, but yes I am sure you did learn a lot. Also you can write in your lease for next time that if the rent isn't paid by the fifth (or whatever arrangement you want to make) that you will begin eviction proceedings. It starts with a paper that notifies them they have 7 days to pay or you will begin with the eviction process.
