Eviction question (gettin evicted soon)?
What happens if I get evicted before my lease is up? Do I still have to pay the months that I will not be there. I am threatened with getting evicted if I don't pay my late fees and rent by Jan. 8 which i 100% cannot make. My lease is until June though... so am I going to be forced to pay that too, but not be allowed to live there?

Your state may or may not allow late fees to be included as rent if landlord files for eviction based upon non-payment.

You can't be evicted without a court order, and and the length of time that takes varies from place to place.

Once you are evicted, your lease is terminated and you are not responsible for the rent for the remainder of your lease. They will keep your deposit and apply it to what you owe. If you owe a lot of back rent, they could sue you for the money but most landlords don't. They just report it to the credit agencies.

They can sue for any back rent, but once your evicted the lease is no longer valid.

do not get evicted, it ruins your credit! they will make you pay everything, what you owe and a fine for breaking the lease which might be like 1 or 2 months rent, plus you cant live there, try to work something out with the people

apartment complexes will just put it on your credit report how much you owe you will not be sued

They can sue you for the entire amount owed plus all court and legal fees which could be very high. The best thing to do is negotiate a graceful exit and pay the penalties. An eviction will hurt your credit rating. A mutually-agreed-to ending of the lease does not.

depends on what your contract says....more than likely you will have to pay all the way up to June and pay late fees. it'll go on your credit report and will be difficult to lease a new apt. try to make arrangements or check to see if you have a tenant council in your area that might be able to help.

If your landlord and you have a lease, then you must follow the lease?
If you cannot afford to pay the late fees, just ask your landlord to a fix and deduct policy of the lease,.?
Ex; cutting grass,snow removal , and act fast?
by law you should be paid a min wage and not for free.The way the world is today landlords are having a hard time with rent being paid on time and not at all? If this is not avail, and you want to stay untill the end of the lease, just talk to your landlord and if he/she is human you'll be ok. BUT, if he/she isnt human, be the same jerk that the landlord is , find all the problems in the apt or the house, write them down, get them certified and put your money in ESCROW at the local courts.
The landlord will not be able to end the lease and will have to stop the threatening, he/she must fix all the problems in the house/apt before you release the money from ESCROW and if you feel he/she may still try to an Evection, Just keep paying your rent to the courts and in the ESCROW account?
Intimidation is a CRIME and could be a Criminal charge for your landlord?
The courts and the Escrow account should be free accounts and if not the landlord should be held accountable and be known as a SLUMLORD!!

Bottom line, if you get evicted, you may be responsable for the rest of the lease, you dont pay, you get Evicted, and yes you will have to pay the remaining lease agreement?
Unless your land lord finds a person to move in and take over the lease?

Check your local rules on landlord nenant law? Some states requier a landlord to own 4 or more units for fix and deduct?

If you can not make rent they can throw you out and sue you for the back pay on the months you were there not after you leave.

Only a judge can evict you......You have to be served....Then go to court........You have to loose..........and if you loose you have two weeks before the sheriff come to lock you out............If non of this has happened then their just trying to scare you.......I stayed six months for free before I finally got evicted

You are getting evicted for being delinquent in your rent payments. The landlord will take you to court for your unpaid rent all the way thru the end of yur lease in June. You will also be assessed the landlord's attorney's fees and all court costs. This will forever be on your record.
