Ex-boyfriend dosen't want to leave apartment.?
Me and my boyfriend have recently split up. He does not want to leave the apartment. I was orginally the lease holder, and later added him to the lease. The lease is up in a month in a half. Can I have him removed from the lease? Or can I renew the lease in a month and a half with out him?

Thanks for the answers, He did sign the last renewal lease so he might be a co-tentant. Me moving is not an option because everything in the apartment belongs to me, The only thing he owns is his clothes and one TV.

you can have the lease renewed without him... by adding him you've only made him a tenant living there (like if you had children) but he's not responsible for the rent so he can be taken off the lease at any time. talk to your landlord so they know in advance that you'll be renewing without him on the paperwork... also if there's any drama your landlord will have a heads up on what's going on. in the mean time, if he refuses to leave, have the locks changed (of course with the landlords ok). if he still refuses to move on then the land lord can request that he not come on the property again... then if he causes drama at your place he can be arrested.

pray it doesn't come to all that drama but if it does... it really helps your landlord to know what's going on... to you it's your home but to the landlord it's their place of business and they want it running smoothly without drama and craziness. if you keep them in the know they're more likely to help you deal with it instead of being surprised by a 3am fight that's waking the neighbors.

You probably cannot remove him from the lease but can definately leave him out of the new lease. He has a right to be there if his name is still on. Check w/ your landlord.

Talk to your manager because you were the original lease holder when you first moved in ... See if he will remove his name off your lease asap and that could give you rights to call the cops to have him removed from your apartment ... You can show the cops the new lease holder paperwork IF the manger has removed his name off the lease and given you a new copy of the lease contract. Ask your manger if he or she is willing to renew the contract right now ...

Talk it over with your landlord and see how the contract has been drawn up. If you're the primary lease holder, I think you can renew without your ex.

Ask the Apartment Office what your options are, but I'm pretty sure he'll have to sign something to end his part in the lease. Maybe they can move one of you into another apartment until the lease ends and renew you there. If your homelife is ugly or violent I would find somewhere else to stay until then.

No, you are jointly on the lease. Therefore, he has equal rights to you. You should both look for another place.

yup you can.. and if he won't leave you can throw him out..just wait till he leaves and change the locks..yikes..if he gets violent you can get a restraining order..why won't he leave?.whats he a wussyboy or what?

You can ask your landlord not to include your ex's name on the new lease. This way you and/or your landlord have a legal way of removing him from the property.

Don't make life more complicated than it has to be. Send a note to the landlord telling him/her you are planning to move out but would be open to another unit in the complex (assuming you want to stay there). Your focus has to be on moving on not "winning." Let him have the apartment.

I'm sure you both have equal claim to the apartment so why bring more drama into your life for no reason (unless you like drama- then stay the course).

conact your apartment manager.. explain the situation to them and ask them if you can remove him. I think you can if you are listed as the primary lease holder....
then call the police and have him removed from your home....

Regardless of the lease you can call the law to have him removed. If you get along okay, then wait for the renewal and only put your name on it. You should also trying speaking to your landlord and see what they can offer you also. Good Luck!

You might as well just live it out. Legally he has a responsibility to mitigate damages if you move out but in 45 days he won't find a new roomate. You can renew the lease without him once your lease expires.
