I received a notice of trustee's sale saying that on 11/12/08 my house is going to be put in auction sale. I don't understand if i have to be out of the house by this day. Some people say yes and others say that i have to get out of the house when the property is sold. and that i should received a eviction notice. Laws vary from state to state. Is this a legal notice? Has anyone tried to serve eviction papers to you?
Usually before the house goes to auction, the mortgage holders or its agent has gone to court to get you out of the house. If you are not out they would petition the court to have a writ, a writ is essentially a court order to have the sheriff bodily remove you.
I am a landlord and goes to court regularly. I get to sit through many foreclosures and writs.
I would go to the courthouse to see if you're in file system. You may have not gotten notice, but listed on the eviction papers. If you are listed, get out ASAP. You don't want anymore added fee's. If you are not, call the people who placed the notice to find out the details.

They usually post something on the front door to be sure the people occupying the home is out within a certain time... If that date is what was given to you, then, yes, you must be out by that date.
If you don't you could be forced physically to be out without having time to remove your personal belongings, thus losing everything you have in your home. |

When the SWAT team shoots the tear gas into the window. I am sorry to hear that you got in over your head. You sound like a very uninformed person. Have your ever thought about calling and talking to your mortgage holder? I think they would know better than anyone here.
have your ever thought about renting out the rooms? have you called your local city hall and government representative to see if they have any new or older programs to help you refinance, get a personal loan? if you put a ad on Craigslist I bet you can rent every room in the house in a week.
There are private investors who are looking to buy foreclosed houses before they foreclose. It means they can give you a chunk of money, before you leave your house to them instead of the bank. You can put an ad on craigslist for this matter too. |

Laws vary from State to State. You need some legal advice or at least a good conversation with the people who are selling the house or the Sheriff's department.
Don't just blow it off because when the Sheriff shows up at your door you, your family and your goods will be physically removed. |

once it is sold, you'll get a notice posted on your house. usually you have 30 days to leave afterwards. i'd start preparing now. |

no, you don't have to be out by that day. that's the day of the sheriff sale. if someone buys the house ( and that's a big if) , they have to start the formal eviction process to have you removed from the property. so you have some time. |
