Faxed Copy of lease signed, never moved in, received deposit checks back, do I have to pay 1 month rent?
I signed a fax copy of a lease to hold an apartment in another state. When I got to that state (24 hours later) the apartment was in horrible condition. I advised that I would not be signing a hardcopy of lease and requested my deposits back . Hardcopy could only be signed on weekdays, they don't do paperwork on weekends. The agent on duty gave those back to me (I lost the credit check fee etc). On Monday the property manager called and stated that I was still obligated to the terms of the lease and should at least pay one months rent. They do not have a hardcopy of lease just faxed.

you rented something without seeing it ? people get scammed all day like that. but,they held the apartment for you based on your word. If i was them i would hold you to the entire term of the lease or until it was re-rented.

I think you just got to town and found something you liked better and now want to change your mind the property owner should not be responsible for that

I know the world in which I work, a fax signature is as good as a real one. It shows that you saw the document, read the terms and were agreeable to the terms. At this point, the landlord can take you to small claims court, maybe you can convince the judge that it was only a fax, but don't count on it.

A faxed signed copy is just as good as a "hard copy." Million dollar contracts are signed that like that all the time. The apartment being in horrible condition does not make it uninhabitable, unless it has rodents, missing outside walls, missing the roof, etc. Something that literally makes it impossible to live there. You are lucky that they are not trying to hold you to the entire term of the lease. I would pay the one month's rent and count your blessings. Never sign a lease for a place you have never seen, even if it is by fax.

Here's the deal....

Your signing of the fax copy is legally binding. You are therefore bound to the lease, as is the landlord.

Your obligation is to pay rent according to the terms of the lease. The landlord's obligation is to provide you with a habitable apartment on the start date of your lease.

The fact that the apartment was not ready on the exact date specified does not mean you get to rescind your entire lease.

Your remedy is whatever costs you incurred as a result of the apartment not being ready on move-in date, which would be the cost of a night or two you had to spend at a hotel, and a day or two of extra storage fees that the moving company charged, if any. Mention this to the landlord, and I'm sure he will discount the first months rent to compensate for you not being able to move in immediately. But, don't expect them to let you off scot free.

READ your lease. It may state that your faxed copy is good, generally is. Your claim will be that apartment was NOT as represented and they defaulted and you owe nothing. Fact that they returned your docs indicates that. Scare tactics by them.

I have to concur with Bob W and Angie. I think you could be on the hook for the time period in which it sits vacant until it is re rented. Plus any other fees and penalties imposed in the contract. You may be teaching yourself an expensive lesson.

I think that this is a legal question and depends on the laws of your state. Every state has different laws on real estate and leases. I think that if you faxed them a signed lease that that fax is good and you signed it. They did hold the apartment for you and they might have cleaned it up if you had asked them to? When I moved into my apartment, I had to pay out of my own money to have it cleaned up. It was a mess. I would try to negotiate with the manager. Good Luck!

Great post! I completely understand your question. Money is hard for a lot of people right now since the enconomy is going down. No.....send a letter certified return receipt requested....since the apt promised was uninhabitable....you are not signing the lease......(although he could push that the fax copy is binding)...

But since the apt violates the lease......google your state and landlord/tenant laws and tell the landlord he has XX amount of days to return your deposit IN FULL....

Some states have 30 days.....but AZ, for example, only 14 days to return.
