Flatmare refusing to pay rent.?
My flatmate is refusing to pay rent, however she has signed a joint lease but the rent comes off my account.
She quit her job and now has no money but she's refusing to contribute ot rent, bills or council tax.
Is there anything legally I can do to make her pay up?

If it is a joint lease you are both respnsible for the rent in part and totally. You must let your landlord know asap.

You will have to go to small claims court probably to get any money out of the ex flatmate.

It is a bad situation to be in. Your landlord will have seen it all before and be able to advise you.

Have the landlord change the locks and don't give your flatmate a copy. Explain to your landlord why you are doing this so that he knows it is not you that is not paying.

No, legally there is nothing you can do and this is the danger of living in a share house.

All you can do is tell the landlord but, if you've signed a joint lease, then he'll just consider that you're jointly responsible for paying. The problem then is that if the rent isn't paid in full, he's going to try to evict both of you and/or take both of you to court. You really don't want this on your record as you won't be able to rent another place for at least five years.

What I would suggest is that you talk to her. Say that you understand that with no income she can't pay rent, but what does she intend to do about this? How long are you supposed to pay her share? Does she intend finding another job? If she doesn't intend doing so, will she move out of the property?

At the end of the day, you are her *flatmate*, not her mum, dad, sister, brother, spouse, whatever ... and it's not your place to provide for her financially.

If you get nowhere with her, and you can't afford to/don't want to keep paying her share, all you can do is give the landlord notice and go your separate ways. Even if this means a fine for breaking your lease, you may be better to do this then keep paying her rent.

I know it's hard - I once had a flatmate who had been out of work for five months so wouldn't contribute (and this was in 2006 when there were a lot more jobs around than now) but that didn't mean that any of the rest of us could afford to pay his share! It was the source of so many arguments in the house. Eventually we were all asked to leave so that the landlord could sell the property so I've no idea what would have happened if we'd all carried on like that.

Also, I once had a friend who had a similar situation with her flatmate, so she sold all her flatmate's stuff on eBay to compensate. I don't know if I'd have the guts to try that though!

That's one cheeky mare you are sharing with that will let you foot the bill for everything. Throw her stuff out and see what she has to say about that - the landlord cant do it, but as she obviously doesn't value your friendship or her commitment to her tenancy, play her at her own game. u would be best off taking it up with someone official i made mistake of having guy not pay for 2 months... i had to pay everything, i had to kick him out, he also broke a window and kicked my front door in but i made him fix those that after i brought it up at work, the guy was an utter **** eventually he had to move departments cos i refused to work with him, sometimes only way to deal with people like that is to give back them the same treatment

Warn her you will pack up her belongings and dump them outside unless she forks up and get that joint lease sorted out so half comes off her account - or all of it and you settle with her. Go see a solicitor if you are really concerned and get on to the Council.
