HELP I just rented an apartment for a 1 year lease. Now she wants me out???
Now, 3 weeks later, my landlady says she needs her apt back beause of personal reasons. She is telling me my lease isnt valid because i didnt go thru any board association for aproval from the building etc... ??? IS she allowed to kick me out like this? she has not said she will return my deposit or pay for my moving expenses or anything! I am very worried as my roomate has told me she comes in when we are not here... what can i do? help!

did you read your lease? She might have put a clause into it that states that she can give you the boot if she has given you sufficient notice or if she has proof that you have done anything illegal

In Australia If you have a lease she cannot kick you out, also she must give you 48 hours notice if she needs to inspect the house she is entitled to do so every 6 months and you have the right to be present during inspections. if you are leasing through an agent contact them. Otherwise contact consumer affairs / real estate council.
Read your lease.

Get a copy of your lease...get an attorney...you may need to hurry and get some type of injunction against her. This sounds like a con to me. I bet she is getting first and last monies from lots of people and then kicking them out. Go onto a state or county website under your county recorder section and see if you can find out who is the owner ... she may not even own the building...if not I would try to contact the owner and let them know of her practices...get your locks changed ASAP. YOU CAN get the locks changed plenty of people do when they move into apartments ... I would leave a big banner in the apartment telling her if she enters again without permission you will call the police. What she gonna do throw you out.

Check with your local Housing Rights group.

This information can be found by contacting your local cities housing department. You can find your cities web page by going to www.ci."YourCity"."StateAbrev".us

Ask for information regarding Renter Rights and disputes.

This is usually a city sponsored department of non profit organization. There will be no cost for their services.

Make sure you have a copy of all of your paperwork, and check to see if the Landlord cashed your check.

If all of that fails you may need to seek legal council.

Read your contract and see what it says about Board Association.

If you have done what the contract says, she can do nothing without your consent.

If you have not done everything it says, it may still not matter, as the breach has to be an important one, so speak to Citizens Advice.

But if you can move, you can ask for your money back, plus your moving expenses in and out, plus a hefty compensation for canceling the contract, inconvenience, etc. It is up to you.

Refuse to leave. Make her take you to court. If you have a lease, she'll have a hard time getting any judge to take her side. Even if one did, it could take months for her to get anything done. If she's coming in, and she's going to kick you out anyways, change the locks. Try to tape her coming in as well. That should give you some bargaining power.

They can help you with your predicament..

i agree get a lawyer she has to give you all your money back!!! hid your copy of the lease sounds like shes trying to find it!! even if you didnt pay rent she cannot legally kick you out in the street!!!! i knew someone who lived in her apt for 6 months without paying a dime in rent before the plice finally gave her 30 more days to leave!!!

if the lease is signed by both parties and there is no mention of an approval needed by the board association she is out of luck, and if there is she should have gotten it before allowing u to move in, first threat is to tell her to call your attorney, if she asks who be sure to have one lined up, sounds to me like u have a case, dont cave, by law she can not come in to your apartment without notice, if need be place cameras in the apartment to document her entrance without notice, fight fire with fire, but be sure to get a good attorney sounds like u r in for a long battle.
