Hi everyone,
I posted a while ago about how my parents have insane tenants. Recently we had a family emergency that my parents had to tend to the past few weeks. Last week we got a letter stating that the tenant wanted to have the furnace serviced - we brought a guy in to service it, he said it wasn't up to code, and so he shut the system down yesterday. We called several places last night, a few came in today to give us estimates on replacing it and we are planning on having it replaced tomorrow morning. When we got home we had a voicemail from an "enforcement officer" from our bureau calling in regards to the house??? This lady is constantly sending us demanding letters, screaming at us on the phone and we are trying our best to get this fixed. It will be fixed by tomorrow - what should we do? We tried to call back but they had already left. I don't know what this is in regards to but there was nothing else we could have done but replace it!
They have been really demanding and uncooperative from day 1 - I understand that it needs to be replaced, and we will do so..but why call the police?? Additional Details I mean I totally understand that they need heat and that is why we have been working as quickly as possible!! We also already told her we agreed to fix it asap.
She is just so problematic and we signed a three year lease with her!! She was previously in the real estate industry so it seems she knows every way humanly possible to give us a hard time.
What are some legitimate grounds for eviction?? |

It will work out quite nicely that you weren't able to speak to the enforcement officer until tomorrow. Just say "We are aware of the problem and there is a company scheduled to arrive at (time) today to replace the furnace. Is there anything else I can help you with?"
As far as the tenants who scream about everything. All you can do is know your rights. Let them complain about stuff that they don't have the right to complain about. If their complaints aren't valid, they will fall on deaf ears at the code enforcement department. When you talk to the tenant on the phone, be reasonable, firm, and above all calm. If they get out of control, just hang up on them. Tell them that you are willing to work with them if they are having problems, but until they can act like adults and have a reasonable conversation without getting upset and yelling, you aren't going to talk to them. I would ask the tenants for a written list of all of their concerns. Ask them to make the list clear and concise and tell them that once you receive their list, you will review it and take action. If they refuse, then tell them you are trying to be reasonable, and until they can do the same for you, you can't help them.
Also, review the written lease. Look for any technicality that would allow your parents to evict them. If you don't have a written lease, then you technically have a verbal month-to-month contract and you can simply give them a written notice 30 days in advance that you are kicking them out, no reason required. I would send it via certified mail so you have a reciept to prove that they got it. |

Tell her you have a 3 day grace period, and if she keeps harassing you, you'll be forced to terminate the lease.
Is there one? If so there is ALWAYS a reason you can get someone out, (legally).
I'd figure out how to get her out before she has your home condemned!
Though if you are worried about getting in trouble... Bring her over a small heater until you have that one fixed. Make her sign for it. And if she refuses the heater, make her or a witness sign that as well.

The enforcement officer is probably an officer from your local City building safety department, and not the police. The tenant is entitled to report violations in building codes to the City, in order that an enforcement officer can investigate and order the work be completed, if necessary. They protect tenants from unscrupulous landlords who expect tenants to live in terrible, unfit conditions, and I am not saying that is the case in what you describe. |

they want you to look like slum lords. just get it fixed and don't renew their contract. or give them 30 days to get out. i had tenants like that too. good luck. also, just because she complains about every little thing doesn't mean you need to replace it. ignore her letters about little things like the grout in the bathroom or whatever. even the windows you should have. get a building inspector in there and see what needs to be done. do it and then forget it. |

You really cant blame her for being upset about being without heat in December. I think you should have offered to put her in a local hotel until the problem is fixed. I understand you are doing what you can but that is where she lives and she may not have a choice other than to be demanding. What if she has nowhere to go?
PS. whoever gave me a thumbs down... TURN OFF YOUR HEAT for the night. you may be able to understand what the woman is going through. |

Some people behave like witches. They don't necessarily fly on a broomstick since SUVs are more comfortable, but they behave like them nonethelss.
It sure sounds as if though you are better off without her. If you absolutely need to stay there for the next few days, try to put up with her, and make sure you call the same officer that took down her complaint, so that you can add your side of the story.
What would I do? I'd go on craigslist.com

housing--apt, rooms or house
you should be able to find plenty of places that are open for rent or on sale, and maybe you will find a nicer person who isn't as psychotic as the one you are dealing with now.

You're in the wrong. It's December, they need heat. You should give them the month off from rent payment for their suffering with no heat (hot water?) You and your parents sound like slumlords. |

Unfortunately when your a slum lord those are the risks you take. Just have everything up to par next time and tell that tenant that things will be fixed asap. |
