There's something not right. Did you get title to the car when you bought it? If you did then you don't anyone anything. If you didn't then what did you get from them when you paid the person.

Not sure if you can go back to those that sold you the car, because they MUST have known that they hadn't finished paying off the finance of the car... and wasn't as genuine as they seemed...

Get to your local Citizen Advice Centre or your local police station to see what your rights are...

But you should of really got a car HPI check done on any second hand car!!!

You need to act on this. Basically, the car was not the sellers to sell as it was effectively owned by the finance company. First of all, you need to contact the seller and get a bankers draft for balance outstanding in favour of the finance company. I would BOTH go the post office/box to send it so you both know that it has been sent. If you have no luck you need to report this to the police immediately as it is fraud - don't be too hasty doing this as they are the ones that could take the car away from you - try and sort it out with the seller. Next time you buy a car, do an HPI check (about £40) which will confirm whether the car has any outstanding finance and the car is the car is says it is. On the positive side, the seller could be intending to repay the finance with the proceeds of the car - not strictly legal but many people do this. If he says that he is going this - then contact the finance company to check he has.

First, did you get a receipt for the sale? Call an attorney, they consult for free. If there was financing on the car and the title was changed over to you, you will most likley have to take the original owner to court to get the money. Call Judge Judy, the winners get their money from a fund so there is no chance that you won't receive the money after you have been awarded the judgement.

No it's your fault for not checking the credit history of the car before paying for it.The finance Co have first claim on the car, and if you do not settle the claim they will repossess the vehicle leaving you out of pocket and with no car.Whether you would succeed in a private action to reclaim the money you lost from the person who sold you the car is debatable.Even if you won a case, have they the means to reimburse you.Also the cost of bringing a case could be prohibitive.I think you have got to put this down to experience.Do not buy vehicles privately without the necessary checks.Either buy from a dealer or pay to have the checks done.It's people trying to save a few pounds foolishly that run into trouble. It's better to pay a bit more and have peace of mind.In your case it was false economy. Hope you haven't lost too much. The only guy laughing is the fellow who sold you the car.

phone the old bill first. the other seller has broken the law.
2nd they cannot take the car without a court order, they wont get one if more than half of the car was paid for.

Ouch. I'd call an attorney. Quickly.

You need to unwind that transaction and get your money back, if they even still have it. You might even need to get the police involved, if this could be considered fraud. Sounds like it could be to me.

But the bank has every right to take this car from you if they didn't get paid properly. And that's not something you should lose money over.

You should have HPI'd the car before you bought it. It wasn't the other person's car to sell whilst it still had outstanding finance, so legally it isn't yours to own either. You need to be back in contact with the person you bought the car from (and I think you need to be knocking on the door and not telephoning.!) Good luck. Could be a tricky situation and I hope you're not the one caught out here.
