HOW CAN YOU BREAK A LEASE AND STILL GET YOUR DEPOSITS BACK?
My fiancee just moved in to our apartments a month ago exactly yesterday. the 15th and we have to move to texas A.S.A.P. we paid $200.00 deposit plus a additional deposit of $731.00 that is almost $1,000.000 thats alot of money. we need to break our lease but still get that money to use to get another aparment in Texas. does any one have any idea how to do that....in deperate need of help. i only have 2 weeks to do this... HELP!!!!

There is no legal way. Your landlord might simply give it to you, but he/she does not have to.

Be prepared, you may actually find yourself owing the rest of the lease, at least rent for Oct. If the landlord sues you over this they will win, you can not break a contract simply because you want to. It is a legal contract.

I go to landlord forums all the time and I NEVER see landlords asking, "How can I keep someone's security deposit even though they gave me plenty of notice, and took good care of the house."

You owe him for his lost rent. It's not his fault, you have to pack and leave with no notice. Hopefully, he'll sue you for the rest of the contract to teach you a lesson. Don't sign contracts you don't intend to honor.

Legally you might not be able to get all of it back.

If you broke your lease early, your landlord may sue you for damages... the damages being his loss of income... the amount of rent EACH MONTH he/she would lose, until he/she can rent the apartment to someone else.

This is probably spelled out in the lease you signed.

Sorry, you are likely out of luck. The lease is a binding contract, so they probably won't let you out of it and are under no obligation to return your deposit.

Why were you and your fiancee so dimwitted, that you signed a lease just a month ago, and now 'have to move to Texas' ? Time for you to wake up and understand that leases are binding legal agreements. If the apartment management sticks to its rules, you will lose your entire deposit and will be sued for any unpaid rents. You will end up with a small claims judgment against you. See how easy it is to get another apartment with THAT on your credit file. Yes, it goes on your credit file, and is available nationwide.

Renters: A lease is a binding contract! You people need to understand that.
Your problems are not your landlords.
Call your bank and tell them you want out of a loan.
When you break your lease, you will owe more.
Plus it goes on your credit report, if they are smart.

I would try to negotiate a fee to break the lease. You can always ask.

Give a 30 day written notice and leave the place really clean and in good repair. They still have the option NOT to let you out of it until your lease is up if they want to be sticky about it.

You are breaking your lease, which you signed only ONE MONTH ago. A family emergency is not a reason to break the lease.

You are grasping at straws by complaining about these issues now. Did you notify the landlord of these issue in WRITING prior to wanting to break your lease. I bet not.

A move in sheet is not required by law.

Neighbors banging on the wall, screaming, laughing and throwing loud parties ... you need to call the police. The landlord cannot do much without proof - a police report.

The landlord can hold you liable for the rent until either the lease expires or a replacement tenant is found.

The landlord can hold you liable for advertising costs and agent fees or any other costs he may incur due to your breach.

The landlord can hold you liable for the cost to return the return back to the condition in which you received it upon move in.

All of the above mentioned costs can (and will) be deducted from your security deposit.

You are not getting anything back.

In fact, you are likely going to owe.

If you do not pay, expect to get sued.
