Sarah | Has anyone ever broke their lease? |
I have an apartment that I didnt pay a deposit and didnt pay for the first month. I thought I could handle the rent but now I know I cant. My rent is past due, I have no credit history except for my student loans for going to school. Im not sure what I should do because I want a cheaper apartment. Would it hurt me if I just left and if so could I find another apartment.? |

talk to your landlord and see if you can sublease it, They may take you to court or not. Most states have a law that says the landlord can not collect twice on a property meaning that if you have to pay for the months since you broke the lease they can't rent it out and basically get twice the rent. most landlords that i've had have been very understanding and I have had to break a few leases (mostly due to job transfers and while I did have a few of those covered with a transfer clause I had a few that weren't), and have never been taken to court. |

Talk to you landlord about your situation and try to work something out. I'm sure they'd rather work with you than sue you. |

You may not have a credit history, but you will if you break your lease and/or owe back rent....your credit history will start out in the gutter.
While the landlord can't "get blood from a turnup", he can and will get a judgment against you, garnish your bank account, (unless you live a state where its prohibited, garnish your paycheck, but worse, future landlords will just throw your application away.
And that judgment stays on your credit report for 5-7 yrs!!!
Think carefully; if you are already late, he's probably lying in wait to start the eviction clock, when he does, let yourself be evicted and move right away.
On the upside - he can only get a judgment for a specific amount usually back rent and late fees and court costs - but NOT the remaining months on any lease.....Landlords have a "duty to mitigate their own losses" and to encourage them,
the courts decided that they have to actively pursue new renters and then they can sue you only for the months the apt was actually vacant, but ready to rent
good luck |

That is really strange and uncommon that you did not have to pay a deposit. If you signed a lease you can not just break it like alot of people think that you can. Usually you will have to pay a few months rent, usually over $1000 to break it in some cases. Other times they do not allow you to at all. If you just leave it will go on your credit and when you try to move into another apartment, they will contact your old landlord you will get a bad refrence and it will probably be hard to get another apartment.
I wouldnt know what to do in your situation so all I can try to say is talk to your landlord, explain the situation and maybe they will have a heart and try to help you out, make payment arangements or somthing.
Is this a complex or somthing? Usually most apartment complexes will not allow you to live there unless you make a certin amount of money. They make sure you can afford to make rent every month. They a landlord usually you are just a rent check, and they want to make sure they get there money.
I'm really sorry if that brought you down. |

Generally when you break lease you have to pay at least half of the next month (often they will ask for the full month to compensate for them not having a renter for the first month) |

if you did not sign a lease or pay a security deposit you should be alright as long as you give them 30 day notice and make sure the apartment is in the same condition that you left the apartment but find a way to pay the past due before you leave it may hurt you when you try to find another apartment |

They WILL take you to court
they WILL get your $ for every month that you have broken the lease until one year from the original date of leasing
there WILL be a court record for prospective landlords to look at
You might not be to rent another place for a long time- |
