Has my girlfriend a claim on my house?
my Girlfriend has been living with me in my house for 5 years. The relationship is all but dead. She has her own house which she rents out, and the rent she recieves pays her mortgage with about £120 left over. She pays me £50 a month to help with bills etc. My out goings to keep the house running is about £1,100. When we do split has she a legal claim on my house even though she has one of her own.
Also if she has got a claim on it. Would I have a claim on hers, as if it was not for her living with me, she would not be able to rent it out and have the mortgage payed

who's name is on the legal paper work for each house?

if you split and the house was yours first then it will remain yours as long as you never put her name on the deeds

If she paid for work on the house and can prove thatshe paid, then she may be able to claim the cash back from you in a court of law because the house is yours but say a fitted kitcin or bathroom suit she can not take with her.

I doubt it as you are not married and I assume her name isnt on any of the bills etc particularly the mortgage. I would ring the CAB or a solicitor just in case.

The key is whose names are on the deeds - if hers are as well then the house is classed as both of yours and she therefore has a right.

She could claim back money for work done on the house that she and you paid for - but, it would be best to speak to the CAB. It might even be, if the relationship is dead, she won't ven try to make a claim off you. Depends how "bitter" the two of you have become.

as she's lived there over 12 months she can make a claim on your property. she would need to show she has contributed to the upkeep of the property while she has lived there, and this isn't always a monetary contribution. she can place a restriction on the property with land registry to prevent you selling the property until this is sorted out. things have been tightened up in this regard in the last few years due to the increase in couples co-habiting. hope this helps.

Providing her name is not on the mortgage then no, no claims at all.

I'm only speaking morally here and not legally, and it's only my opinion. 5 years is a long time, if you both have been living as a couple for that time and all of your decisions were made based on a "life commitment" and what you have together/combined during that time accumulated as a team should be split as a team.
But, it sounds to me like you both were together yet living seperatly. And even thou her financial contrabutions were not equal the two of you worked together to build a home. Also it sounds like you bought your house before she got there? Or did she help you get there. no matter really.
NOW, Being that she had a nest egg befor she met you and was able to let it grow. Is still really hers.
And as far as what you both accomplished together, and forgive me cuz I don't know the details, but I would hope that you can treat her fairly. Perhaps, she would not even ask for "her share"
Dollars and cents in every household is not the only factor. 5 years as a couple means that you both intended to be together forever. I hope you can stop being angry and think fairly. She probably won't want it anyways. Perhaps this question of yours is whats holding you guys back. Get that out of the way and maybe you can get on with the relationship. lol
