Having problems with a dodgy landlady/letting agent?
Ok so we were living there for 6 months under a shorthold tenancy (moved out 3 weeks ago). The house was a mess when we moved in; the boiler was leaking, the kitchen doors had mold growth on them, 2 of them subsequently fell off as soon as we opened them. The gas fire and pipes were condemned by the electrician doing the safety checks, the hedges were so overgrown we couldn't even reach the tops (the neighbours asked us to ask them to cut them down a bit). There was a huge pile of rubbish (household waste) in the back "garden". They made us jump through so many hoops so we could rent this dump. I didn't know of any of these things when we went for the viewing.

The letting agent has decided we wrecked the kitchen, we didn't keep the gardens tidy, the downstairs carpet smells of dogs (which it might, we do have dogs) and the oven needed a more thorougher clean. All this added up to £250 for repair and cleaning. but they've applied through the DPS for the whole £370! We didn't wreck the kitchen, it was wrecked beforehand, the gardens were strimmed 2 weeks before moving out (they went to see it 2 weeks after that so 4 weeks growth in the middle of summer). I cleaned the oven and the worst the carpet would need is some shake n vac!

Anyway to the question; What can I do about this? The agent is 200 miles away, the lady doesn't know her rectum from her elbow and the boss is never there. I phone and phone, e-mail and e-mail only to get a reply off the stupid mare saying he's not there. I'm fuming, what can I do? I took some photos when we moved in but only after the doors fell off. I didn't think to photograph the smell or the oven. I asked the guys that helped us move and they said there was no doggy smell.

If you didn't fill out an inspection upon entering the leae, you are SOL. If you didn't fill out an inspection report at the end of the lease you are SOLX2. If it isn't on paper, you lose the protections.

Don't confirm your acceptance to the DPS - register a dispute.

If the agent/landlady do not have an independently produced inventory that you signed when you moved in, it is very unlikely that they will win any dispute procedure


Where's my scooby snack?
More than likely, the landlady knew about the condition of the house before you moved in. However, since you've already moved out, you no longer may have any tenant rights.

You could try to sue her, but not sure if your case would hold up in court.

Note: SOL means S...h...i...t out of luck. On the inspection note, it is a good idea to do a quick run through of the place to make sure everything is in working order. An actual inspection sheet is not required to be filled out by the tenant, but u should make a mental note or jot down on paper. Or next time, you should ask your landlord for an inspection worksheet and then fill it out accordingly. This should protect you against any false claims the landlord might make in the future.

They are providing you an excellent education in "how to be a tenant" at a very low cost. Pay the money, shut up, and get on with your life.

Then perhaps start a website or blog on how to avoid this kind of problem, and who knows, you might become a highly paid author or consultant in the field of landlord relations. Clearly the UK has a need for a book on "How To Be A Decent Landlord And Still Make Money" and another on "How To Rent A Flat Without Getting Flattened."

YOU didn't do your Due Diligence.
Many (most) of the items you mention you should have been able to discern upon viewing the place, before agreeing to take it. Anything else, you should have put LL/agent on notice ASAP, in writing, about condition of items, need for repairs, need for removal of rubbish.
You need to write a polite, businesslike letter to LL/agent, noting condition of the premises when you moved in, what you did when you moved out, requesting return of deposit and disputing the necessity for repairs.
Register a dispute with DPS a week later.
It is QUITE likely there is a doggy smell, particularly when it is humid, even if you cleaned carpets. Takes thorough dusting and vacuuming of all surfaces, particularly corners, and more than one carpet cleaning to remove the odor. You're probably used to it.

Name-calling won't help the situation.

Quit calling and e-mailing. You're getting no where doing that. They'll just keep avoiding you. Send a written letter, by certified mail return receipt requested (or some other form of mailing that shows delivery confirmation). In this letter challenge each of her deductions. State that the garden was in good shape when you left and tell when you last weeded it. Tell about all the problems you found in the unit at move in, and that you shouldn't be charged for those things now since it was already in that condition. (You will have to pay to have the carpet cleaned. That's a usual charge for anyone who has pets to remove the pet dander before a new tenant takes occupancy.) State that you want all the money returned except for the carpet cleaning. Keep a copy of the letter and the postcard that comes back confirming delivery. See if she responds to the letter. If not, filing a dispute or court case is the only way to get the money back. Keep your dated photos for that hearing and gather witnesses that will testify to the condition of the unit at move out and move in.

Register a dispute with the DPS. They have an arbitration service that can be used if both you and the landlord agree, if not the DPS will not release the money until a court sorts it out. Court is easy and relatively inexpensive at http://www.moneyclaim.gov.uk

The court case will be held in your current area, which might mean the landlord won't attend the hearing, but even if he does, he'll have to PROVE all the damages he claims. Proof means something like a signed inventory (signed by you) from when you moved in showing the state of the garden and kitchen cupboards. You don't have to prove anything other than that you paid the deposit, the onus of proof is on the landlord.
