You have to evict him through the court system. You actually may have to make your landlord do it, since there is no lease between the two of you.
Legally this is his residence and you can not kick him out without a court order. Also, his friends would not be trespassing. This is his legal residence, he has as much of a right to guests as you do. |

It amazes me how the fear of violating or breaking a lease will cause people to stay in situations that are intolerable.....
Give your landlord written notice......kiss your deposit goodbye.....and MOVE OUT!!!!! So, sometime down the road the landlord pursues you for lost rent or damage.....okay.....it doesn't sound like you can avoid the damage or violence by staying....geez.....
Find a place to stay, get a storage unit lined up....next time scary roommate is at work .....move out....be gone.... |

You state he made verbal threats to you. The easiest way to get him out is to get these threats to destroy the apt or harm you on videotape-use a hidden cell phone camera next time you confront him about moving out. |

Go to your local police station and find out what your options are. I'm sure you can get a police escort to get him out since he isn't on the lease. While you're at it. . . get a restraining order. Good Luck! |

I had this problem. I don't know what the legal precedence is in your area. I asked a cop that is a friend of mine. He told me the legal way to get him out. The advise is legal, free and he may stop by to help you while off-duty. You can't beat this. P.S. (Make sure you ask him about clothing in the home. You want to avoid - the 'Domestic Clause.') |

Since his name isn't on the lease and yours is the only one that is you should be able to call your landlord and have him take care of it. If not, try calling your local police department (not 911, but the number in the phone book). See what they have to say. If he has threatened you, then you can have him escorted out by the police, possibly arrested, and you might be able to get a restraining order against him. It all depends on what state you live in also. Try your landlord first, see what they have to say. Then contact police if your landlord isn't very helpful. I would just try to get this taken care of soon because you never know who someone really is, and I'd hate to see anyone get hurt. Hope this helps. |

Got any big male relatives or friends? Have them start coming over and give the guy a bit of an attitude adjustment.
Tell him on a certain day (his 'next month for sure') you're having the locks changed. Then do it.
At that point, if he comes around, it is trespassing and you can call the police, especially if he has been threatening. |

do all you can to get him away from you.
You can kick him out because he lives under you as your name is on the lease not his, but if he's paying rent do it through the court/ landlord. |

Call the non emergency police line and explain the situation. They can have him removed. Just be prepared to move because nothing is going to stop him from showing up at your door even if you change the locks and if he has threatened you in the past you don't want him to become violent.
Start putting things that are irreplaceable in a bag or suitcase now and stash them with a friend. |

If he pays rent then the police won't do anything to get him out. Go down to the court and file eviction notice on him and legally get him out. Even though he's not on the lease if he's paying rent then he has rights.
You can try calling the police and asking if they will do anything. |
