Help! My apartment manager wants to charge a late fee?
I put my check in his slot the morning it was due, but he said he never got it. I always make sure it goes completely in, so I know him or one of his employees has it. There isn't a way for me to prove that I gave him the check because it never got cashed. Now he wants me to pay the late fee + the rent. I already tried to persuade him not to charge the late fee, but he won't listen. Is there anything else I can do?
Additional Details
I tried handing them the check before, but they just tell me to put it in the slot. When I asked for a receipt, they said to just use my bank statement as one.

Stand your ground. Tell him that you put it in the slot first thing that morning.

Tell him that with all due respect, you refuse to pay the late fee. If he still wants it, tell him he can sue you -- which I doubt he will do because I doubt the late fee is enough to be worth it.

And from now on, when you put the check in the slot, follow up with a phone call to him later in the day -- tell him that the check is there, and DEMAND that he acknowledge the fact.

In my experience, most landlords I've dealt with have been nice and fair -- but for the one or two who haven't, they only seem to know one language, and that is assertiveness. Some landlords think they can push tenants around, but if you stand your ground while at the same time show that you're a good tenant, they'll back off.

Unfortunately there's nothing you can do. From now on make sure you hand your check to him in person.

I pay mine by money order and hand it to them and always ask for a receipt. Since you have no proof that you actually paid it- you will have to pay the rent again and the late fees. Do not use those slots- they always cause problems!

You have to pay the fee, but learn a lesson from this. Send your check certified mail, OR demand a receipt when turning in your check.

Some people have said NOT to pay the late fee. That is a very bad idea. The next month's rent will most likely be applied to the late fee first, leaving you with additional unpaid rent for the next month, so on and so forth until you have enough unpaid rent/late fees to warrant eviction proceedings.

I suggest sending it certified mail, it's a pain and it costs a few dollars but it is certianly less expensive then a late fee.

Pay the late fee, just to get it over with. Write a new check and cancel the old check (quickly in case someone stole it). Every few months or so (I do it once a year) write post-dated checks and send them by registered mail. Landlords aren't allowed to require post-dated checks as payment, but they're not likely to refuse them. My landlord loves that I do it that way, she has 600 units and the people that give her a year's worth of checks save her a lot of time.
