Help!! Rent just went up $35 dollars with no notice?

Raising the rent is not illegal in any state, regardless of what some posters here say.

You have to be given a 30 day notice though. He had to inform you by July 2 if the raise is in effect Aug 1.

The 5 day eviction is a warning, and does not require any other warning. It is not an eviction, but a notice that he is going to file eviction if you don't pay your rent. Evictions take 30 days. I would strongly recommend you avoid that, they stay on your credit report as a warning to future landlords that you do not pay your rent. It is hard to find a new place with that on your record.

They can give you a notice, but that doesn't make it legal. It's usually a mind game. Feel free to push the issue, but get receipts for your rent payments!

Usually, rent increases when the lease renews. There maybe exceptions because of the recent sale however.

Check you state laws kiddo. You didn't even mention what state you are in, so I can't help.

Before I say anything, I would like to point out that I'm NOT in real estate, so do not quote me on any of this to your landlord... but I do know:

If you have a lease, and you signed for a certain monthly price, he cannot raise it. At all! However... it might be for repairs or something, so before you jump down his throat just ask him. If he says its a new monthly price but you signed a lease saying differently, he cannot do this.

If you don't have a lease, I don't know what the rules are. He didn't sign anything saying he couldn't raise it, so its probably likely he can.

Also, the eviction thing is an odd process. If you have a lease signed and he wants you out, he can probably find some tiny clause that you broke, even if its something stupid and was months ago, but since you signed it, he could kick you out. It's a jack*** move, but he could do it.

However, if you don't have a lease signed and you're just living there, he has to bring you to court to kick you out, which can take up to 6 months, so you can live there until then or until you find a new place, and you don't have to pay him any rent. He might not be pleasant, but I think legally you're allowed to do it.

Basically look over all the terms of your lease, or if you don't have one... you should research what the laws are for that, and it would probably help to start appt searching...

no he cannot just change the rent without notice. did u have a signed lease with your old landlord? if so that lease woudl be transferred to the new landlord and would be good until the period of time expires. if u have no lease then he is just in raising the rent. also he cannot evict u in 5 days, he must give 30 days notice to evict and then go through the courts to get a court ordered eviction. if he tries to remove ur stuff or anythign else than call the police that is illegal.

my dad is a landlord, and when he raised the rent, he informed the tenants a month before, and he also had to fill out a form, that the landlords had to sign. I have it saved on my computer b/c i usually help him out a lot with his work, so i would get it to u to show your landlord...otherwise what he is doing is illegal since their is no document.

Rent raise - no. They have to give you notice. Unless it is in your contract that the rent was going to be raised to so much on a certain date. Also, they are not allowed to raise it more than 8% in a calander year of your last rent raise. (This is a rent control law in CA, I'm not sure what state you live in)

I'd speak with your property mgmt. company or your landlord. If you don't go through a prop. mgmt. and just have a landlord, I'd get out of there if he's rude about it. Its just a bad precursor to what could come.

Edit: In my understanding that when a NEW LANDLORD, not your landlord that you signed the lease with, comes into the picture rules can change. Your lease was with your OLD LANDLORD, not the NEW LANDLORD. The NEW LANDLORD can up the rent. Go ask a lawyer.

Yes. A new landlord can raise your rent. However, I don't think he has the right to give you 5-day eviction notice. Legally I believe you have at least 30 days.
