Help....i moved into an apartment building and my landlord moved her daughter into the one next to me...?
My family moved into an apartment building and then the landlords the very next month moved her daughter and the boyfriend in right next to me...she phones the police on our noise eg.tv.and the police have been here and threaten to fine us..we did not have any noise on but we have to prove it.She is very spoiled even the parents said so.Quote from landlords,well we don't want the b'tch livin with us..her own mother said that..me,my husand and daughter are scared to even walk around the house for fear she will call police but she is allowed to make noise,fight with her boyfriend,get drunk and disorderly and fight and swear with her boyfriend AND they are allowed two parking spots and i am allowed half of one cuz they take up the parking spot...we are quiet,don't drink or cause trouble and we are in our late forties,they are in early twenties.what can i do to get help.we are on budget so hard to move but we will if this cannot be resolved peacefully.Thanks for any advice.

call the police and documant everything you just said plus all the upcoming epoisodes, and then if nothing else is done about it i would file a small claims court case against your landlord, because wether it there daughter or not you pay money hard earned money to live there and like you said not everyone has it where they can just pick up and move so first call the cops, and if it dont stop there take everyone to court, you cant take it anymore and you and your husband and daughter shouldnt be living like this, she needs to grow up and maybe she would if they kicked her out and she had to live in the real world, no other landlord would tolorate that behavior from any tentant it just sucks he is only putting up with it because she's his daughter and she's not bothering him, well you dont pay rent each month to be harrassed and bothered, get as much documated so you dont forget anything and get on the phone you want to be in a noise disturbance and file a complaint and small claims court with your local court system. good luck i hope she gets thrown out.

This is what I would do wait until the next time they are drunk and yelling at each other then call the police on them one will go to jail

Letting her get away with that is the worst thing you can do.

WHen you hear noise: CALL THE POLICE. If the police come and say "Well we cant do anything", then ask why you get fined when she calls the police on you when there is NO noise.
Parking spot? Call Parking Enforcement and have the vehicle tagged/towed. Tell them you are renting the apartment, and somebody's car is on half of your spot.

If they get drunk and are fighting, definitely call the police. If she asks you why you did that when she's sober or her parents ask, answer honestly (if at all). "We dont do anything and she calls the police on us. She is the one always getting drunk and fighting, and I cant use my parking spot either. Of course I had to call the police. She should expect the same treatment she gives other people"

Report HER for the noise and problems she causes. Tell your landlord you will move out if she can't behave properly. I doubt he wants to lose the money.

Honestly though, it sounds like you just need to go ahead and move. Start looking quietly though. Good luck :(

Tough situation, when they make a lot of noise though I would definitely call on them, usually I am a fan of resolving issues without police involvement, but if she is almost fraudulantly calling on you, in this case it is justified. Next time you see the officers, calmly explain to them the situation and they will likely start ignoring her noise complaints.

Now for the legal. Most residential contracts have a clause ensuring quite enjoyment of the rental property. If the landlords daughter is infringing on that right, you can claim that the landlord is in violation of the contract. Be prepared to have to get a lawyer though if the landlords want to keep you in your contract.

The clause in my contracts with my residents (this is a standard clause) reads:

14. QUIET ENJOYMENT
The Tenant shall be entitled to quiet enjoyment of the Apartment for the term of this Agreement provided that the Tenant pays rent in a timely manner and performs all covenants and obligations under this Agreement.

I don't think they can fine you unless you really are making a lot of noise. Its most likely just a threat. Wouldn't your neighbor have to prove that you're making noise? (innocent till proven guilty)

If she does all of that then call 911. She has a telephone and she knows how to use it . . . You don't have one? . . . And even if you do have one . . . You don't know how to use it?

There is nothing stopping you from calling the police on her is there?

Secondly, does the landlord own the building, or are they just on site managers?

If they do no own the building complain to the equities or property management company who does.
