Help, my tenant won't move out! Any ideas?
He says he is moving, and I think he really means to, but it just keeps getting put off. His rent was paid through Aug 15, the apt. is clean and he is hardly ever there, but his stuff is and I have new tenants waiting to move in. I have spoken to him 3 times this week and I hate to be a nag, his parents are friends, but this is getting a little old. He keeps saying "I'll be out by _____" and the date comes and goes with no evidence whatsoever of an attempt to move. Hubby threatened to start charging him rent again and he assured us he would be out by Wed, but he wasn't there all day today, and nothing is moved. This isn't hostile, but I am beginning to feel a little desperate.

Tell him to meet you at the house one day. Don't tell him why, but bring a bunch of bags and boxes with you and tell him you and him are going to get his stuff out of the house right now. If he tries to get out of it or leave or something, tell him that if he doesn't do this right now then you will do it while he's gone, and when he gets back all his stuff will be out on the sidewalk (maybe you could even charge him for you having packed up his things for him) and he will not be allowed back in the house because it belongs to other tenants now and not to him anymore. It sounds harsh, but you can say it in a nice, very calm matter-of-fact way and he will have no choice but to either help get his things out or to leave when he gets back from being a flake. Good luck.

You need to give him proper written notice to terminate his (default month to month) tenancy.

If he does not move per the notice, you are going to have to evict through the courts.

He is stringing you along and until you follow your state's laws, he can continue to do so. You have taken no legal steps to properly remove him from the property.

Most of the advice given here is dead wrong and will get you into major trouble.

You cannot lock him out.

You cannot remove his personal possessions from the property.

You cannot put his stuff in storage, box it up or put it to the curb.


You can call the police, but they will not get involved. This is not a criminal matter, it is a civil matter and must be dealt with through the courts.

Get his commitment date in writing, and tell him the prorated amount for each day he occupies the unit (until he turns his keys in) AND CHARGE HIM. He will not get out in a timely manner if its FRee! If he knows you are serious he will get out. If you have it in writing, if he is not out by Wednesday, go to the court. This is your investment...don't let a friends family member take advantage of you!!!!

DON"T throw his things on the curb. DON'T lock him out. DON'T put anything in storage. YOU would be breaking the law! Even if he is a tenant through a friend, he still has all rights of a tenant and you need to follow the landlord rights by filing a legal eviction.

Threatened to charge rent? Why wouldn't you charge? I would charge hold-over rent at a premium price! You are leaving yourself open, and should decide if you're running a business or a baby sitting service.

If the lease is up - that is, there is no CURRENT lease agreement between you and the tenant, and the rent is not paid up to the current date (that is, TODAY), then you can simply remove his stuff from your place.

He is no longer a tenant. He is a squatter.

look up your state landlord/tenant laws.

if he is paid through till aug. 15th then he is now living there rent free. do not accept any rent payments from him. if you do, your case becomes moot and the cycle starts all over again.. see what you need to do to start an unlawful detainer(eviction). this appears to be the only way you will get him out. do not do a self help eviction or you will be the one in trouble. you need to take this to court.

treat it like a business. If you have a lease, there should be verbage that covers this. My lease states that at the end of the lease term a daily rental rate of ___ will be charged if the resident has not agreed to a new lease or moved. the next step would be a vacate notice and possible a landlords lien depending upon your state law. By the way, just because the intial term of the lease has expired , this does not mean that there is no longer a lease, it just means that the terms and conditions are on a month to month basis

Unfortunately you are being taken for granted. Talk to him, set a date with him, say a week or so so that he doesnt have the excuse of not being able to find a new place, and then tell him that he has to be out by nightfall that date or you will remove his stuff and change the locks. it may sound harsh but why should you lose all that rent money for the sake of someone who has no respect for you and is taking you for a ride.

Was there a lease signed? Put his things in Storage & rent it out, you are the Landlords, do not let the parent friend thing get in the way, YES< CHARGE HIM RENT......... call him & tell him Rent is Being raised........ and I'm sure he'll be out tonight. If you know his parents and care about them, let them know what he's doing to you.

Give him a him a time limit to move out, like let's say 2 weeks, even he doesn't move out then and his contract his expired, you do have the right to call the police.

I have family that has a lot of these rental issues as well. It does make it harder that your friends with the family. Best thing to do would be to move his stuff out tomorrow around noon into a storage area, or your office, and when he comes back to his place, say that someone has paid to stay there, and you we're just holding on to his stuff until he returned. most of the time my family just calls the police, or turns of the electricity in the apartment, but in this case it makes it harder. But honesty is always the best policy! If all else fails, tell the other family that you have a business to run, and have a job to do!

just tell him that you have prospective tenants wanting to move in and they need a move in date. Tell him that he needs to give you an exact move out date and tell him that you are not trying to be mean but that you are holding him to this date. If he is not out by the agreed date, then either charge him rent like your hubby says or take it to court♥ I know you want to be nice since it is a family friend but you also dont deserve to be walked all over♥

well u wont have to see him anymore so get ur husband to tell him to move out by ____ whatever date and say if he's not he'll have to pay rent again. and if that dosent work and his not paying or moving get his stuff and just leave it outside and call him to collect it .even offer to drive the stuff to where ever he's going

Take his stuff and it's technically yours because if he's not paying any storage charges it's yours. You can also evict him if you really don't want him.

It's a passive aggressive tenant you have there isn't he?
There are many things you can do but where do you live? Because the provinces have different laws governing the tenants and the landlord. So do the states down south they all have different laws governing apartments, houses, and rooms to let.
I would move his belongings out of the apartment before your new tenants arrive if he hasn't done it himself. But that's "iffy" depending on where you live. It's well past the fifteenth now and I think you have a right to do so. I also think that once his belongings have been moved out onto the porch or into the basement or shed out back, change the locks.
