Help with my landlord and what my rights as a tenant is?
i lived in this house for 1 year now, and am moving out this month, this landlord is horrible, he doesn't fix anything, he won't listen to my complaints, there is mold in the basement and he wont get rid of it, and i have a 4 month old baby! the furnace is broke and it leaks oil, he also wont pay to get that fixed or replaced, this is an older home and i understand older home has more problems, but he is the landlord, and he should be aware of that also. So since i am moving this month, he decided to hit me with a $1500 phone bill, when i moved into this house the phone line was still hooked up. but it was a fax line, he did not tell me about the phone and that there was even a phone line already hooked up. So i used it, nowhere in the lease does it say anything about a phone bill i had to pay, i never intended to get a house phone anyway. I know he is a slumlord because he told me i have to transfer the electric bill into my name, and i called the electric company and they told me the landlord had to cut of the power because it was in his name, and he never did, so it was an agreement that it stay remained in his name and i just pay whatever the bill was, which was fine. but as for te phone bill there was no verbal agreement nor an agreement in writing, it was his fault he didnt cut of the phone, or inform me not to use the line, since infact it was a phone line, he is a slumlord and i want to know if i have to pay that bill, or if i dont i will get a lawyer because it is not in the lease that i have to pay for a phone bill.

also every other utilies is included in the rent, water, sewer, but i pay for trash and oil, and he pays for the cable, and everything that i am suppose to pay for is indicated in the rent and agreed to, and even the cable is int the rent saying that he pays for it, but the phone is nowhere in the rent, and he did not mention anything to me, so i assumed he paid for it since all the utilies are included in the rent, i pay1700 a month for this place so he didnt tell me otherwise that the phone was my resposiblilty

It sounds like this is your bill. You used the phone line, you should be paying for it. You knew in the first place it was not yours.

How does not paying YOUR bills make HIM a slumlord? It sounds more like you are a deadbeat.

No lawyer would be able to help you, it was criminal activity to use a phone line that is not yours in the first place. You should be grateful he is not having you arrested.

The phone bill was not mentioned because it is always in the tenants name and paid for by you. You thought you were getting over by using the phone for free. You used it, so he can sue you for the bill. But it was also his idiocy for not getting it cut off. If you had simply made local calls I would probably tell him to drop dead, but you made over $1000 in long distance or phone-sex calls, so I'd sue you.

Your local Legal Aid just might have a booklet called tennants rights. Here in Rochester Minnesota, you can pick one up for free from them. Check in the yellow pages of your local phone book.
Now personally, I think you are liable for the phone bill since you were smart enough not to not use it and you never bothered to spieak to him about it. It also never said that you could use it in the lease so that is a tough call and I think you would lose in a court case. Still I could be wrong and that is why it is a good idea to get some good legal help from legal aid.

It's not the landlords fault for leaving the line in...it's your fault for using it. You should have questioned him on this when you first moved in.

Unless your lease specifically states that phone services is included, then I'm afraid your responsible for the bill. Phone service is not considered a "utility", but rather a paid service.

I think you know what you did was wrong and your now trying to find a way around it.

If it is not specifically stated that a phone is included, it is NOT included. With leases and contracts they state what is to be included. the absence of an items means it is not included.

Since the phone was not included as an item, and you used the phone, you are legally responsible for the cost of that use.

Where do you get the absurd idea that you can use a phone, run up a $1500 bill and then not pay for it? Don't be a deadbeat! Pay your bills!

I believe that if you used the phone bill knowing that you were making the calls that you should be responsible to pay the bill. But on the other hand I also feel that you should report the landlord for the way the house is. In most states the landlord is responsible to fix whatever is wrong. I would contact a lawyer for a free consultation. Make sure you have pictures of everything that he is responsible to fix when you take it to a lawyer he would be able to tell you what your rights are. You might actually come out ahead just because he did not do any repairs. Good luck.

Well what you should have done and still should do until you move is put your rent money into escrow. Look it up for your area and what happens is he cant evict because your paying your rent but not to him until he fixes the things wrong in the house. I would look that up and talk to them because they can give you exactly the right information based on the laws in your state!!!
