Holding back rent payment.................?
I can't seem to get anyone to come fix my toilet. So I'm thinking about holding back my rent payment until they do. Can I legally do that? I'm on a month to month lease, I live in Florida. I'm really getting sick of having to fill the tank up with water everytime I want to flush the toilet. And no I can't move right now.

No, you can't hold back rent. They could evict you. Check your lease. Does it say what kind of maintenance is covered? We had an issue with our toilet where we're renting from now on two separate occasions & both times, maintenance was there within an hour. I can't understand why they would make you wait so long when you have nowhere to use the bathroom! Call your landlord right now and say, "My name is___ I live at (address). My toilet has been messed up (describe problem) for (amount of time). I have told you about this multiple times. If someone is not here to fix it by tomorrow, I will get an attorney." Even if you're really not getting an attorney. It will scare him/her into fixing it.

Also, in almost every US state, if the landlord ignores maintenance, you can call in 3 professionals & get written estimates for each. Make copies. Choose the least expensive one. Pay for him to fix it. Deduct it from his rent & when you pay him rent, give him a copy of the estimates & receipts. It's legal in most states.

If you with hold your rent you could be served with eviction papers for lack of payment. This would remain on your record, the eviction.

You need to notify the landlord or management of the issue in writing via Certified mail, return receipt requested. You are required to properly notify the landlord or management if the issue and give them a reasonable amount of time in which to repair the problem before taking any further action.

You do not say how long this issue has been going on or how you notified the landlord or management.

It is never a good idea to withhold rent payment or repair and deduct unless your state's landlord tenant laws allow you to take these actions and you have followed the steps required before taking such actions. You need to search Florida's landlord tenant laws to see what is required of you and what rights you have regarding repairs.

If you do not pay rent in full, you can be served the proper Notice To Pay Or Quit and then have an eviction filed against you.

If you take it upon yourself to repair and deduct without the landlord's written permission or proper prior notice, you can be evicted.

FYI: Since you are a month to month tenant in Florida, your landlord can terminate your tenancy with only 15 days notice without any cause or reason. You state that you cannot move right now, however, if you do not follow the laws or mishandle this issue, you could find yourself having to move per the landlord's choice.

Some pretty good answers, but it does depend on your city/state and their particular renter clauses.

Have you contacted the landlord? Have you contacted him more than once and ever documented your attempt? Certified Mail, as someone mentioned, is a good way since it requires a signature to receive...it's proof someone saw the letter. Make sure to keep copies OF EVERYTHING.

Also, if your issues are unresolved, then have someone come out and take a look at it. The best bet is to have more than one person give you a repair estimate so as to eliminate any questions...preferably three. You'll probably have to pay out of pocket, but use your rent money if need be. Again, the details of this are best answered by your local municipality, but also, KEEP EVERYTHING--INCLUDING ALL BILLS AND RECEIPTS--AND COPY EVERYTHING.

Finally, when it comes to withholding rent, it's not as simple as just not paying, otherwise, no one would pay. From what I remember, you are required to notify someone within your local government that you are not paying, and why. This may require writing the check, but leaving it at the municipal office as proof you're not just trying to skip rent.

Again, all of this is very general, and you will need to get specifics from your local courthouse.

No, you can't do that because they can legally evict you then.

Why don't you just fix it? Toilets are very easy to fix as long as you have a water supply line which goes into the wall. If you have to fill it to flush, then you need a new fill valve. You can try to fix the old one or you can buy a new one, they're really cheap. The only tools you need is a crescent wrench.

not sure about your city, but you could get the toilet fixed yourself by a plumber, save the receipt and deduct that amount from the rent... always, of course, save a copy of the receipt for your records..

My landlord is an A** and won't fix anything or do anything. Holding back your rent won't fix anything It'll just screw you over.
And yeah as the others suggest. Inform the management company the apartment is under that you're taking it into your own hands and getting the toilet fixed and will deduct off of your monthly rent. And if they say that's fine that's great then, but if they don't take them to small claims court. After all, you are paying to have everything work correctly.
