Home rental security deposit: who owns the interests?
Hi. I've just moved out of the flat I've been renting for 2.5 years and I was wondering whether I am entitled to get the interests earned on my deposit for this time or if the landlord can keep this.

The interest goes to the landlord unless he used one of the deposit schemes from a finance company where the interest would be payed tothe company as there fee for looking after the money!

I am a landlord in PA and your security deposit is supposed to be help in an interest bearing savings account. These accounts usually earn less than 1% so it's never big money. If he hasn't already given you back your deposit he should do so within 30 days. If he keeps any part of it, he must provide you with a detailed list of what he is holding back for

We need to know were you are because the laws are different from state to state. In fact, here in Oregon it is illegal to use an interest bering account, so there is no interest involved.

It depends on your state laws. Some require the landlord to put all deposits in an interest bearing account and give the interest to the tenants yearly. However most states dont require this. Check your lease under deposits. It should, by law, tell you. Or call your housing dept at city hall. They should be able to tell you.
Here in MI, we are not required to give interest.

i think you will find by law you can claim it. your landlord should have it in a third party account so it should be gaining some sort of interest even if its only a little bit.

Unfortunately no, it is the landlord's, if he invested it in shares and lost money, you wouldn't be wanting to pay for his loss!

All of the money goes to the landlord. It is up to them if they want to give you anything back. Sometimes, if you leave the building clean and in good order, they will refund you some of the first or last deposit.
