A lawyer is telling you to pay him? No, do not give him anything. I can not even think of any situations at all where you would pay him.
You pay the landlord. He is the one you have a contract with and he still owns the property. "going into foreclosure" does not really mean much, other then he is late with his payment. |

You tell the attorney that you are legally obligated to pay the landlord under the terms of the lease until the attorney gives you legal documentation that the property is no longer is the landlords control and that you are legally required to pay the new owner (the foreclosing bank) |

don't listen to some of these people. the fact that the home is in foreclosure does not discharge you from your rental agreement. you pay the landlord until such time as he/she no longer owns the home (ie foreclosure completed). keep in mind, that this is not a "short sale". in times like that, the lease would be parcel to the sale and you would simply be paying the new owner. in a foreclosure, the lease is not parcel to the sale and it is null and void at the point of change of ownership. the fact that landlord is "pocketing the cash" and not paying the bank with the rent that you pay him is not your concern or your problem. his lending agreement was between him and the bank, and doesn't expose you to any liability or absolve you of any responsibility.
what typically happens at that point is that the bank will send someone there to offer you a "cash for keys" agreement. they typically offer you a certain amount to vacate as soon as possible. otherwise, you typically have 30-60 days before you are evicted. then, the sheriff's dept. can come and remove you. anything still in the home at that point is gone gone gone. it is in your best interest not to let it get to that point. i would suggest that you start looking for a new place to live, right now. |

Tell that attorney to take a flying leap, UNTIL he has some sort of court order indicating that you are to pay rents to him. Meanwhile, you pay your rents to the owner of record, since that is with whom you have a rental agreement. Once ownership changes hands, you get to pay your rents to the new owners. |

As long as the landlord is the legal owner of the property, you must pay rent to him/her. Failing to do so would be a breach of your lease.
Don't listen to other poster who say "don't pay, he's only going to pocket your money"...they are so wrong and have no idea what the law is. Your contract with the landlord has no bearing on his contract with the bank. What he does with your rent payment is not your concern...nor your business.
Pay the rent to the party you have a legally binding contract with or you may face eviction and/or be sued. |

Ignore those saying you don't have to pay anything. You DO. As long as the property is in the LL's name, you are obligated by your legal lease agreement to pay him the rent. It's not your concern if he is pocketing the money...that is for the foreclosing bank to deal with. You are to honor your lease agreement. |

You don't pay anyone because you were just renting it and since the landlord can't pay for it.. he/she is pocketing your money and not paying the bank. I would find another place right away!! |

You don't have to pay anyone and don't let them bully you. They are just pocketing the money. You need to find out if your state has a redemption period after the sheriff sale. If it does you could stay there during that period, but you will eventually need to find a new place. |
