No you don't get the money back and August 1st you owe him first months rent. If the house doesn't fit your needs you shouldn't of sign a contract and gave the Landlord money. |

A contract is a legally binding agreement. I suppose if you have a leniant land lord hell let you back out. But chances are your going to lose your deposit.good luck |

Please think before you sign leases ..
The landlord has put expenses out to find a suitable tenant which ostensibly was YOU.
If there is still time to find a tenant a GOOD landlord would give you back only part of your damage deposit as he has put out expenses to rent to you and only keep a portion while mitigating his loss.
(the advertising costs, the administrative cost, if he has had to use a paid service to check your references, credit history, criminal record check)
You basicly are trying to duck out on responsibility for your actions. Why did the house fit your needs well enough to sign an agreement and NOW it does not... It is all just too convenient an excuse.
I do not feel sorry for you as you are not being completely truthful.

You've paid a deposit and signed a lease. It's no concern of the landlord that you changed your mind. Advise the landlord immediately of your decision so that he can look for another tenant.
Meanwhile, you're going to owe the rents on the lease until he DOES find a tenant, whether you move in or not. Your deposit is probably history, and you may find yourself being asked to pay a month or two worth of tent until the place is re-rented. |

Depends on the state.
If it was a security deposit and you signed and lease but have deciced not to move in, than there may be a way to get it back.
If it's a "holding" deposit to keep the house from being rented out. Than no.
However, since you signed the lease, your best bet is to talk to the landlord. They may just give you your money back and problem solved. You should absoluteally offer to help find a new tenant for the spot, or if sub-leasing is an option. (you rent it out to someone new, and they'll pay you the deposit)...which will be a pain for you for the next year.
Other than that there's not really alot you can do. Try to mend this amiably so your rental history isn't destroyed.
And in the future, don't sign leases unless you actually intend to live there. |

You should be able to. You've got to talk to the landlord, though, and explain your reasons. He may not want to give you all of your money back--it will probably depend on how long the property has been off the market. If it hasn't been that long, or if he didn't do anything special to allow you to move in, then it's not going to cause him any damages. |
