House fence question?
I live in a terrace house all former council. All my
neighbours like me now own their homes. Did my neighbour
to the right side have the right to replace the fence that
divides our gardens without first asking us. Was this fence not a party fence. Fence was previously 3 1/2 ft now 6ft.

You need to check your Deeds for the house to see which fence is yours and which you are responsible for. Your neighbour can build a fence up to 6 ft.high but that is the maximum IF it is his responsibility to maintain it.

Obtain a copy of the party wall act 1966 (explanitory booklet), or download it for free via the site below.

I don't think it applies to wooden fences, but local regs could apply, hight etc.

There is no hard and fast rule as to which left or right fence is the responsibility of which house, this is normally shown on dead plans with the use of 'T' marks on the boundary line. If your neighbours fence he would not have to consult you but it would have been polite to have done so. Boundary fences in rear gardens can be 2m high any higher and planning permission would be needed, its 1.2m on front gardens.

If you are standing in your back garden with your back to the house then the fence to your right is yours, the one to your left is your next door neighbours.

Joe Kool has it right so your neighbour can do as he wishes to his fence. You can do as you wish to your fence but bare in mind that there are height restrictions.

the best way to answer this question is to get a surveyor! they will survey the land surrounding ur property and they can officially determine the borders along ur property and if in fact your neighbor put the fence on your side of the property. get a surveyor to determine the facts so that there are no tiffs between u and ur neighbor.

That probably depends upon where the fence is in relation to the property line. If it's directly on the line, you are jointly responsible for its maintanence. If it's on either side, it's the sole responsbility of the onwer.

If the fence is on the line, your neighbor probalby should have asked if you would share the expense but if you refused they would generally be free to proceed at their own expense. In that case, you got the benefit of a new fence and some added privacy at no cost so I don't see what the issue is. If they were REALLY good neighbors, they would have faced the "good" side of the fence towards your side of the property line.

no they had to discuss this with you, this is a dividing fence.....actually you were supposed to pay for half of the cost by the dividing fence act law, unless it was proved to be damaged through your neighbors actions. Call your council to see where you stand and what your local shire rules and regulations are.

it depends if it is on the property line or is not if it is they have to consult you if it is just inside their part they dont have too. you can go to your local county office and get a layout of your property line if your not sure.
