We are in NJ. We're interested in a particular house which we have an appt to see. I checked into the tax info and saw who currently owns the home. I just realized he is the real estate agent who listed the house. How does that work? Shouldn't someone else list his house for him? Another agent in his same company is showing us the house. Does he make a commission too? Or just the money from the sale? And if you were an agent would you list your own house higher than you expect to get for it, or already at a decent price considering a little bit of negotiation? I'm freaked out not knowing if we should make an offer considerably less knowing houses aren't selling near us, prices are dropping every week, or maybe he's asking what he thinks is reasonable considering the market. I'm really just rambling. Any thoughts? Additional Details He's actually owned it for several years, recently renovated though. |

Well what you have is dual agency. I don't know if NJ has a "buyer's contract"? If they do, then you need to understand your rights under that contract regarding "dual agency". While it is not uncommon, it is required by law that the listing agent reveal to you that he is also the owner of the home. And the agent working to show you the home, should have revealed to you that by showing you the home, it is dual agency. If they didn't , they have broken the law.
Don't be freaked out, but you do not want to tell either of them your financial information, or anything about your motivation to purchase. Should you decide to purchase the home, of course the listing agent should be listing the home at fair market value, but to be sure, ask your agent to provide you with sales of similar homes that have sold within the last 6 months in the neighborhood. And yes the commission would be split between the agents and the broker. Then decide for yourself what you want to offer.
But know this, if you had an agent representing you alone, you could rely on their expertise and experience to provide advise. It's not too late to find your own agent, but do it before you view the home. |

Why would you EVER call the listing agent to show you a house? It won't cost you any more money to have your own agent that represents you. That alone would help you deal with this situation. |

There are no rules forbidding an agent from selling their own home. They would be foolish to hire someone else, they would have to pay commission.
Your agent will still get his commission, the buyers agent is not effected. He may even get more.
In CA this information was supposed to be disclosed in the MLS, you should not have to find it. |

Definitely get your own realtor and let them do the work for you. Just like everyone else said, it's not a problem for a realtor to list their own property... this is very common.
Just a get a professional to negotiate for you. The seller pays their commission. If they aren't willing to work with a buyer's realtor, move to the next house.... there are plenty of them in this market! |

As an agent myself I can tell you that he knows precisely what the value of his home is. The reason the agent is using the system is because he knows how well it works and he wants to go professional. He knows it is advantageous to his circumstances. |

Make an offer considerably less but not unfair. Being an agent, he or she knows relatively what homes sell for and would like to get the highest price possible, thus the listing price is the highest price possible that is not unfair. Do yourself a favor research how much other homes in the area sold for. Judging from the information, a house owned by an agent is probably a home flipped to make more money and they would like to move it as soon as possible. Definitely lowball the offer, the agent always can counter. |

Get your own representation, not a designated agent from the same brokerage firm. That makes it more of an arms length deal and you can be assured you are being represented fairly and equitably. Dual agency is when the listing agent represents their listing and the buyer. Designated agency is when the listing agent and the buyer agent are from the same brokerage..... how impartial can that be?? Sometimes good, but if you are uncomfortable, then you have a choice. YOU choose your own agent to represent YOU and the seller would pay their commission if you buy. Then your agent could give you guidance on an offer price, negotiate the deal and help you get the house. |

I would work with a Realtor in my side, a "buyers agent", she will check the price of that house.
ASK her for a "comparative marker analysis" where you will find the priced of sold comparable houses in the area.
Then you make the decision about how much you want to offer, take advantage of the "buyers market".
The seller normally pays the fee of your agent!!...then it does not cost you anything to work with a pro!

well most agents tend to list their own houses. it means nothing they aren't getting a commission on it. a rule of thumb is that the seller wants to get the most for the property but the buyer sets the value. so my advice to you is to offer what you think the house is worth. |

In the book "Freakonomics," the authors point out that real estate agents sell their own houses for about $10,000 more than they'd sell for were they owned by a non-agent. He probably gets to keep his cut of the commission as salary if he's selling it through his agency. Be prepared to pay more if the agent is selling his own house. |
