Well, I am confused. You say the brother owns it, but then you say your husband's name is on it. Which is it?
If both your husband and the brother own the house, then your husband has just as much righ to be there as the brother.
Not really sure why you'd want to stay in a house where you are unwelcome though. Perhaps your husband should sell his share to the brother so you can find your own home. |

Much depends on how the property is deeded. If it is deeded "tenants in common" no owner can kick the others out. But if the property is deeded as a "joint tenancy" and one owner holds more than a 50% share of the property, it is possible that other owners could not retain use of the property. If the house was inherited, the property is likely titled tenants in common. |

If both brothers own the house, both of their names should be on the Purchase Agreement and the Mortgage, if one exists, or it was left to both of them in a will. In which case, the brother cannot legally evict you unless he goes to court to have your husband legally removed as an owner. Your brother in law would have to have good reason to do this, like your husband has not paid his share of the expenses on the house for a number of months and that the brother has no reasonable expectation of collecting the back expenses or payment of future expenses. Make sure your husband has copies of the Purchase Agreement for the house, Mortgage and/or Will showing that he is part owner. He should also be able to prove that he has paid his share of expenses, if that is so, or that the brother can expect to recover back housing and future housing expenses. Do not pay any future expenses to your brother in law in cash. Pay with checks or money orders and keep copies of all payments. Write on the check money order what the payment is for like 1/2 mortgage payment, taxes etc. Make sure to keep copies of all receipts. If the brother is paying the mortgage and taxes, insist on copies of the bills. |
