How can I add my spouse to the deed on my house?
I bought my home before my wife and I were married. The problem is, her name is not on the deed or mortgage, and I would hate to think how the state of Texas would complicate things for her if anything happened to me. How can I add her name to the deed on the house?

You can call the title company that handled the closing when you purchased the house or you can call an attorney that specializes in Real Estate. It shouldn't cost more than $200-300. You just have to go in and sign a addendum to your deed saying that you want her name added. It only takes a minute.
You don't have to contact the mortgage company ahead of time.She doesn't have to be on the loan to be on the deed. Just send them a copy of the updated deed after it is recorded with the courthouse.

it is called a quit claim deed - find a title company in your area to pre-pare it and file it in your county - you can not put her on the mortgage unless you refinance and she qualifies to be on the loan - I know in the state of MN it is 50/50 once you are married - name on property or not

Hi amashburn,

You do not have to refinance to just place her on title.

You want to submit a quit claim deed, or in some states it's called a warranty deed.

Keep in mind although she will have a vested interest in the home, she would not be under obligation for the debt.

To achieve this, then you would have to refinance.

1. refinance the home, in both your names, in order to add her to the mortgage.

2. talk to a real estate attorney about preparing the deed to add her to it, IF you only want her added to the deed.

*if you refinance to add her to the mortgage, then during the refi process you will have the option of deeding it to both of you.

Go to an office supply store like staples, and get a grant deed. Get it notarized then take it to the county recorder's office and have it recorded. That will put your wife on title, there's really no need for her to be on the mortgage. However most mortgage companies will add your wife's name to the loan as a contact person.

Keep it this way to avoid the house from transmorgifying into community property! If you must, obtain a form Grant Deed, deed the house to yourselves "husband and wife as community property", and arrange to have the deed recorded with your local county recorder.
