How can I fight my homeowners association?
Our homeowners association is trying to force us to remove our direct tv receiver because they do not like the fact that a couple holes have to be drilled through the walls of our condo. We own this condo and we would love to keep direct tv as it is almost $100 cheaper each month compared to our alternative option (Comcast). There are several other condo owners who have either dish or direct tv and they have not been forced to remove their receivers, so I do not see why we should have to get rid of ours. I feel like this is discriminatory.
They say that the rules are stated in the by-laws. The by-laws state that you can not alter the outside of the building or affix anything to it. I feel like this should be an exception to the rule if anything. I have a right to have a service, and they are trying to take if from me. Any help or suggestions would be appreciated! Thanks!

I have looked at the receivers of the homeowners who also have dish/direct tv. There is no difference. The HOA is complaining because there are holes drilled through our wall. The same thing was done in all the other homes. It is the only way for them to access the inside.

I live in a condo and we're not permitted to have satellite TV either due to the holes required to mount the dish. There's a billion other things we're not allowed to do, but that is definitely one of them.

It's a battle you can't win because it's in every condo's by-laws. You have to get prior permission, they have to hang it without damaging the structure and so it's not an "eyesore." If you didn't get permission to hang the dish, they have 100% authority to make you take it down, and probably pay for damages to rectify the holes.

In a condo, you do not own the outside of the walls, do not own the land, nor do you own the roof. Therefore the HOA decides what you can and can not hang there. You can't do anything without approval.

We just had a woman sued by our HOA for putting American Flags in the yard, which is technically not hers. They warned her to take them down, she refused, now she's getting sued.

No, it's not an exception to the rule...it's the very reason the rule was put in there to start with.

You have a right to the service, but you DO NOT have the right to alter the exterior of your home that you legally, do not own...you own the air space inside of it..not the structure itself.

That is the difference between a condo and a townhome.

Your other neighbors probably have them affixed to something else, which permits them to have the receivers.

You only have a case of discrimination if your neighbors have them affixed to the EXTERIOR and ONLY you are required to remove theirs.

Otherwise, you have no case.

I caution you to be careful about pushing the issue unless you know you have a legal grounds. If you don't remove the dish they will start levying fines, and then they will place a lien against your home...and the attorney fees will start mounting into the thousands before you can blink an eye that you will be responsible for.

HOAs aren’t usually known for altering their rules. Those rules are put in place to protect all member’s property values. You did agree to follow these rules when you purchased the place.

You should approach your HOA’s governing board and find out what the other satterlite users have done that permitted them to keep their dishes, asuming you know that they *haven’t* also been told to remove them. Your HOA could be cracking down on all of you.

You moved into a place with a homeowners association and you must follow their rules. If you don't like it you should move. As for other people in the condos having dishes to you should bring it up to them and say unless these people are forced to take down their dishes I am not taking down mine.

What is the difference between the dishes of other condo owners and your dish? If you can determine that and have your dish installed consistent with HOA rules, your problem will go away.

The rule is pretty clear, and if your dish is violating it, you should be willing to comply instead of fighting over it.

Well, what have the other people done...I'd follow their lead. If they have other services, other than Comcast, then there has to be a way to get around it. Good luck - HOA are PIA!!!

i have read what others have said. good answers. be very careful about the whole "well, you let cindy have chocolate milk at lunch, why can't i???" type of situation. it really doesn't matter what everyone else is doing. what matters is that the HOA contract prohibits it, and you are in violation. after all, if i drive the jersey turnpike every day and i see a hundred people speeding, and yet i get pulled over...that argument doesn't work with the cop, now does it? the best case scenario is that everyone will have to remove their dishes that are mounted this way...therefore making you the enemy of half the neighborhood (if they find out that it was you). so, not worth it. i would simply comply with the order. direct tv installs everywhere. i'm sure that they can find a way around this that doesn't violate the HOA agreement.

Ok the by laws state that you are not allowed to alter the outside of the building or,....and pay attention here AFFIX ANYTHING TO IT. You affixed the direct TV dish to the building the OUTSIDE of the building is not yours, yes you own a condo but you own everything WITHIN the four walls, the outside walls, roof, stair wells etc belong to the HOA not you, and therefore you violated the condo by-laws.

This is not discrimatory have you spoken to the other dish owners? Have they also been asked to remove their dish? If they have not you have a legitimate complaint.

When I lived in Florida the City of Coral Springs decided that satellite dishes were no longer allowed to be affixed to the outside of the condominium, not the HOA. The City instructed all the owners to remove their dish from the building, the alternative was that they could place in back on the common area on a pole. Whenever new people moved in and they asked if they could have a dish, we told them yes, but you are not allowed to affix it to the building per Coral Springs code please place it on the common area, however, if it gets damaged we are not liable. I had mine placed out back about 30 feet from my condo, the Satellite company ran the lines (i buried them) and into my unit the same place that the cable company had run their lines.

Ask your HOA if there is another place that you can place it. They are legally not allowed to tell you you can't have a dish, they can tell you where you need to place it. You need to come to an agreement on the location of the dishes that will work for both you and the HOA.

Take photos of other satellite dishes attached to condos in your association. Attach the photos to a letter to the HOA asking them to explain why these homeowners are allowed to have the dishes. They can't be selective in their enforcement.

When I lived in a place with an HOA we had a home owner who was redoing his house. He had gotten it all approved but wanted to wait until spring to do the lawn. The rest of the house looked great. It was obvious he was making every attempt to improve his home. The HOA sent him notices about the lawn and threatened fines. Some way or another he took them to court. The case had been going on for over a year when I moved. While it was tied up in court the HOA could not fine him. I went back to visit friends and by this time about 3 years had passed and still no lawn. Out of spite his person had gotten it tied up in court and the HOA could do nothing about it will the case was held up in litigation.

Either fix it or challenge it in court.
