Your landlord should have informed you within 30 days if you were not receiving your deposit.

You will have a hard time proving you received nothing, no refusal. The judge knows that people can't seem to be honest on that account.

You need to take him to small claims and show that you did not damage the property in any way. Pictures work. It is always a good idea to take pictures when you move out.

You won't get anywhere whining about the heater 5 months after the fact. You could have while you were living there, but at this point it is just you trying to point fingers and any judge with half a brain will see through it right away.

Aaargh! I feel for you. I despise landlords that make off with the deposit. I guess you took out the tenancy before the new requirements of registered deposits which is a much better safeguard against this type of thing.

Best course of action? Down to the Citizens Advice Bureau. You'll probably have to get a solicitor onto it. You could try small claims court, but have to say from family experience that the rogue landlords don't always turn up.

If its any consolation, they'll be unlikely able to rent it out, as any rational thinking tenant will ensure that their deposit is registered and secured.

in your contract it should state that one month after you left the landlord should give you your deposit back.
did you report the heating not working to the landlord? if so did you record when you spoke to him about this. if you didnt report this or record when you made the phone calls he can deny all knowledge of knowing it didnt work

I have 2 friends who had exactly the same thing happen to them and they never did get their deposit back
they complained to the council and all sorts about the heating, use of the property as a house in multiple occupation and victimisation of one of the older tenants by the landlord. Council werent interested! I rang social services for the old lady and they went and sorted him out for her.

seems there is a loop in the legal system and some unscrupulous landlords take advantage of that. The landlord I'm talking about has done the same to all his tenants I've since heard
They were told to try the small claims court, I suggest you ring your council and see what they say.

In my experience it is very rare for a landlord to give a deposit back. You can always go though small claims, you do not need a solicitor for this. However it is also very rare for the Court to find for the tenant. People who took out tenancy agreements before the new rules governing deposits came in should always just not pay the last month's rent. Saves all the hassle

You have to go to Small Claims Court in the area where the property is located.

You need ALL the documentation - you lease, the letter notifying the landlord you are moving, etc.

Its something you can easily do. You just need "all your ducks lined-up" to present a good case to win.

I KNOW here in PA, the Landlord has 30 days to return deposits OR write a letter substantiating the claims he/she made for the deductions from security deposit.

If there is no letter or check, the tenant can sue for triple.

EXAMPLE: Security Deposit $500
No check within 30 days after moving out: the Tenant sues for $1,500.

In PA, "District Court" ["Small Claims Court"] the max a person can sue another for is $8,000 AND neither party needs an attorney. Each side presents its own case.
