So I signed a lease for an apartment with two other girls this past spring. By mid-June, I had decided that I was no longer going to be moving to that city for medical and personal reasons. I told the girls and my landlord and my landlord said all I have to do is find someone else to rent it.
While I was busy posting ads and talking to people, one of my roommates told me she had found a friend to take my spot and everything was taken care of. I talked to the landlord and he told me the same information.
Now, I am trying to get my deposit back from my roommate who won't return my messages and my landlord who says I just have to work it out with my roommates. How can I do this? I am thinking of telling the "roommate" that I've been dealing with that if I don't get the money back soon, I will take the matter to small claims court.
What should I do?! Additional Details PS - I made the check out to the rental company, so it went straight to them. |

if you moved out and your name was on the lease and if you didnt destory it . you should have gotten it back within 30 days. if he doesnt give it to you then take him to court.because he can get in trouble. i had that problem to i took them to court and i got it back after court that same day. |

Have you asked your landlord if the new tenant provided deposit also? If new tenant gave landlord a deposit, then your landlord needs to give you back your deposit. If not, then you must ask your roomates for the deposit back. If after you figure out who owes you this deposit and you ask for it in WRITING twice (you usually want to send first demand in writing and if no response, write FINAL demand). FYI - Usual response time is 10 days. If no response, take them to small claims court. Someone has your money and someone needs to give it back. |

If the lease is still valid and your name is still on it, then no, you do not get your deposit back until the lease is up and the "subletter" signs the new lease and pays her portion of the deposit.
In other words, you are still equally responsible for the rent if the other girl doesnt pay it and any damages that happen. She is basically renting from you, just paying rent directly to the landlord. |

Small claims court may be the only answer, to be honest, unless the landlord already received YOUR money from YOU for the deposit, if so, then he is liable for returning it, and charging the other girl for whatever he gave back to you. I have two past roommates (who were once great friends) who still owe me quite a bit of money for past rents and bills, and they to won't answer my calls. |

Yeah. That's totally wrong of your "roommate". You should go with your insticts and tell her that if she doesn't give you the money back, you will call the cops or tell somebody of a higher authority. Nobody should deny you of the money you put down. Don't stand for it. Good Luck! =] |

I wouldn't recommend going to small claims court because that is really stressful, time consuming and it can get ugly. It's a tough situation, but there has to be a way for you to get ahold of her to get your money back. Maybe you can just threaten that you'd take her to court, and hope that you scare her into it? Without actually having any intention on going to court with her? It's up to you I just know how ugly court can be. Good luck! |

I have rented for 40+ years. I always consider that the security deposit is just part of the rent. Even in those cases where I have complied with the landlord's written request upon leaving, I have failed to recover any of it.
If you go on Judge Judy, you can get paid $5000 plus or minus to be humiliated on national television. Otherwise, you can file in small claims, gather your evidence and witnesses, convince your witness to help you, drive downtown, find a parking place in a bad neighborhood, go through security, wait for your case to come up, take your chances with a referee and then head back to your car. If you are lucky, you get back a month's rent minus expenses. And you may have trouble collecting what you won.
Justice isn't necessarily truth.
Remember that you have to take 4 hours off from work, so deduct that. Divide your net return by your hourly rate. I say you end up with a day's pay, if you're lucky.
You're probably better off betting a dollar a day playing your address on the state lottery [back it up] for a year. At least there you know what the odds are. |
