That Guy | How can I get out of my apartment lease? |
I moved in about 4 months ago and had a few proublems that have not gotten fixed until a few days ago and they got fixed by me and it was taken off my rent. There are roaches in my apartment (i have bait traps, they only help a little) and my wife is pregnant. I know that isnt good for her or the soon to be born baby. The basements are supposed to be locked but they are not and I went down there and there is water all over the place that is just sitting and has been and will be for awhile. I am sure there is mold down there and it is just to dark to see. I pay them water, sewer,trash each month and my water has been turned off twice cause they didnt pay it ( i did pay them). I just want to move out and get a better place. Does anyone know how I can? |

I work in the property management industry. It is very hard to get out of a lease without legal help even if you have a valid claim. You should contact the housing authority and the health department for your city or county and find out if they are breaking and tenant landlord or other laws. If they are the county or city can get involved on your behalf before you look for an attorney. There is also a website that you can post your opinion of your community, www.apartmentratings.com. |

The problems that you listed are serious, you may want to contact the appropriate dept. in your state who handle tenant/landlord issues.
If you are paying your rent on time as well paying water, sewer, and trash each month, you have a legitimate claim.
Or you can ask your landlord to let you out of your lease for the reasons stated above. |

You can refuse to pay on grounds that the repairs have not been done. In order to do that legally every month you put your rent into a escrow account at the bank-- Send the landlord a registered letter (take a copy of it) stating what needs to be done and that your money will go to an escrow account until the work is done. Document all work with pictures. Get some light in that basement and take lots of pictures of the mess. Be prepared to show that you had to pay the water bill (twice) despite having paid the landlord.
If the landlord doesnt fix the problems and tries to evict you take the pictures and paperwork with you.
Also the bank can help you set up the escrow account. |

You might be able to take them to small claims court to get out of your lease. Because they are not providing a safe envioronment for you, and your pregnant wife. Just go down there and file a complaint with the town or in lieu of a complaint tell your landlord you want out. He may let you go cuz it sounds like he can't afford to get an attorney. |

This sounds like a classic case of breach of contract by your landlord. Read your lease and outline all their responsibilities.
Then ask to be let out of your lease. Make sure you both sign a "mutual release form" and keep a copy. If they refuse, tell them that you will get the health and housing authorities involved. Bad landlords do not want attention and they will probably let you go to save them the hassle. Good luck with the new kid! |

Well, this is a toughie, but it can be done if you have the right assistance and again this depends on where you are located as to how to do the job right.
You have to realize the information is quite localized so as you look for the information on the topic, you have to get to firstbase with the librarian in your neighbourhood.
There are many libraries throughout the US and Canada, and they can be accessed online if you do a search for them in Google.ca or Google.com. Doing so will narrow down your search by saying libraries and the name of your local area. |

Its always possible,Depending on what your lease says about a lease break fee (if any),its up to them how they will work with you. First write a letter with all of your concerns, expecially the MOLD. Depending on their answer, offer to stay until they re rent the unit without penalty. Just try it all they can say is no or YES. |
