I tried yesterday, all day, to get a judge to enter a restraining order against the landlord. He refused. However, the landlord has not evicted me. Instead, he harassed me with a fake "notice of eviction". Now I want to post a "no trespassing" sign (or something) on my front door of the house and my bedroom door as the landlord said he will be changing the locks and confiscating everything (well, dumping it on the lawn anyways) "tomorrow morning". Please advise ASAP. Thank you. ARIZONA. Additional Details Uh, I'm renting it silly. Therefore he has given up some of his rights to it. There MUST be a way!! Otherwise, what's to prevent him from entering my bathroom while I'm showering or changing??!? |

In Arizona, either there must be an emergency or 48 hours worth of notice or an eviction. Sounds like none of these have taken place so call the police and have him removed from the property, even if he does "own" it. The rest of these people are wrong or chicken. |

There is this lock you can get I will list the link below, you basically put it behind a doorknob and if a person on the other side tries to open it up then it won't. Also if they try to open it then an alarm goes off too. Try to call your local bed, bath and beyond and see if you can get it tonight.
However you don't have much of a choice, I suggest you try to get another apartment somewhere else or swallow your pride, apologize and make a deal with your landlord...like allow him to give you at least 30 days to 4 months to find a new place. |

You can not legally stop him.
No one can trespass on their own property. It is not legally possible.
Why are you sure the notice is fake? If it is real this is exactly what will happen, out your stuff goes.
At that point it is YOU who will be the trespasser and the sheriff will arrest you for stepping on his property. |

Whether the landlord can legally enter depends on your lease and the local laws.
What does your lease *say*?! What does it say about the landlord providing notice of intent to enter? Any? 24 hours? At reasonable times? Hand in hand with that is the requirement on the landlord to provide peaceable and quiet enjoyment of the property: they can't simply enter whenever they want *without a valid reason*. If it's got to the point of going to a judge & threats of evicition then you should be using a lawyer.
Yes, the landlord has some right to enter the property, but you also have a right to privacy and undisturbed enjoyment - they sure as hell can't walk in on you in the bathroom.
Stop asking random people on websites for advice & talk to a lawyer. |

You need a refresher in Law 101. The landlord need only give you 24 hours notice to enter the premises which you rent, and there isn't one thing you can do about it. Furthermore, he does NOT have to give you such notice unless he actually enters the dwelling. He can come ONTO the property at will.
I suggest that you consider moving, since the landlord is apparently going to evict you, one way or the other. |

If he does a self-help eviction, you can go to the court and get an emergent order to restore you to the apartment. You can also get damages.
If someone came uninvited into my shower or bedroom, the best thing that would happen to them is getting maced and the worst thing that would happen to them is that they would be leaving without their penis.
In a situation this severe, you should have consulted with a lawyer and had a plan of action all set up. |

YOU CAN'T!! It is illegal to keep an owner off of THEIR property. That is why the judge refused the restraining order. Posting any trespassing notices and forcibly keeping them off is also illegal. It is illegal for them to go in unannounced and with out 24 hrs notice, but there is not much you can do about that but move and that is a moot point because you are getting evicted anyway.
Why do you think the notice to evict is fake? Any written notice from the landlord stating 30 days notice (or 3 days if you have not paid rent) is legal. It does NOT have to be any official form or anything. It is also illegal, for him to just throw your stuff out on the street. He has to go thru the proper channels and evict you thru the court.
If they are evicting you then you must leave....PERIOD!.... DEAL WITH IT!

You cannot stop someone from permenantly entering their property. You need to look at your lease and see what it says about landlords right of entry but 24 hrs is standard unless there is an emergency.
If your landlord is as difficult as you say, find a new place to go. It doesnt seem that the headaches will end here. |
