How can I stop my landlord from evicting me from an apartment in Texas?
Husband moved out, had to spend money on things like car repairs so I can get to work, and other bills. Need a little time to catch up but apt. manager isn't cooperating.

To you who are so quick to judge(Ocean & Ray M)-I have gotten a 2nd job, this is the 1st time this has happened, husband moved out without much notice-not enough time to come up w/the necessary funds.

A contract is a contract...it is a promise to pay a certain amount by a certain time every month. If you have a good rental history and you've always paid on time, you can usually talk to the manager and make arrangements if hard times hit...but if you are consistently late, forget it. Sounds like you are consistently late . Get your stuff out bfore the Constable gets it out for you. You are in violation of a legal, binding contract if you don't pay. Forget what New York does. In Louisiana, you're as good as gone.

The only way to stop him is to pay your rent on time. Most landlords don't care if you have other things to pay on. If you don't pay your rent then you will get evicted. The landlord has that right. Sorry

*&^(*%(@^!!! Did you get an eviction notice? If so, go to court right away and fill out an "Order to Show Cause." Explain your probs exactly...the court is really on the tenant's side...at least in NY. They don't want people to be homeless and they also don't want the gov't to have to support you. Also let them know--on the Order--some ways you can help to get things paid...the landlord's atty will speak to you b4 you go b4 the judge & try to work something out. The manager is NOT allowed to harass you. Do not do anything except to help yourself until you get an eviction notice. You need to get together the $$$ to pay. The most xtra time you'll get in court is 30 days. If you don't have it in time, go back to court and fill out another "Order" saying you need more time; actually, oftentimes you can do this a couple times...the court wants to help you. It's a scary situation to be in and I wish you the best of luck. Evictions take time and money. First he has to serve you papers. Then you have to answer. All this takes time, times you have to play catch up. Perhaps you need a roomy. Good luck.

Sounds like cash flow is a little tight so if I were you, I would consider the following:

1/ Move to more affordable accomodation.
2/ Talk to your LL and see if you can work out a payment arrangement to cover the rent due...
3/ Divorce proceedings to get husband to provide alimony payments...
4/ See if you and the rental property qualify for Sec. 8 rental assistance.....call your loacl housing authority...
