First; Why would you want to keep living in a home like you describe as "Falling Down" ? Especially with a landlord who is as obtuse as the one you currently have ....
However; IF you really want to continue living there and arguing all the time ; go to your local Landlord-Tenant Division at the courthouse and file the papers giving you the right to withold rents until repairs are completed ...
A faster way; might just be to call the Building Inspector and they will MAKE the landlord bring the home up to code .

Document the repairs and have the civil codes handy that make those legal repairs, or you will lose. |

You have an idiot landlord so you should be able to get away with just about anything.
Technically you cannot withhold rent for needed repairs. What you can do is to send a certified letter to the landlord listing the repairs that must be done and give the landlord 30 days to fix it. The letter should state that if the repairs are not made in the 30 days then you will pay for the repairs and deduct the cost from future rent. But you cannot simply not pay the rent because repairs need to be made. |

It maybe that your landlord is trying to get you to leave. After all, she cannot raise rent on the property if you are the same tenant for the past 10 years - at least not to the levels that have gone up since then.
Check with your local state laws. Communication with your landlord is key too. |

I think you have the right to fix and take off the amount from rent but you have to write a letter stating that is what your intentions are . I think you have to give the landlord 30 days to fix before you can do that. Unless it is a sanitation issue.
I do not know what state you live in but most states have a landlord tennent handbook for just such issues. Your local legal aid should be able to supply you with such handbook. |

Don't know what state you are in or the laws, but that may be your solution. It is not that easy to evict tenants. In most states you must get a court order to remove people and their property, under the Sheriff's supervision. A landlord cannot simply throw you out or your belongings on the street, unless you let them And you can challenge the court ruling. Bring evidence and likely the Judge will rule in your favor. But I doubt the landlord would let it go that far, rather than fixing it.
I've never understood why a landlord would not want to keep repairs up, property value up, tenants happy. I give all my tenant's phone numbers and insist they call repairmen at the first sign of needed repairs. |

I would go to her with this idea. Tell her this is her investment! If she doesn't want to loose money on this investment, then she will have to help by putting some money into this investment to help it keep paying her each month. If she doesn't then you will have to notify the city about the health and hazzard to people. Then it will be condemmed and you will have to move. Neither one of you will gain a thing!! Tell her you understand she has to have money to pay taxes, etc on the house, it is probably paid for by now. But say you speak to her about deducting say a couple of hundred dollar a month for repairs until it is fixed. You can even have a legal contract that will bind you both to this. That way you will feel safe in using the money to fix the place, and she will feel safe knowing you won't be cheating her out of her money, and it will be used for the purpose it is supposed to be used for. Have this agreement notarized by a notary public. Every city has a housing authority. They may have some suggestons also. |
