Depends on the laws of your city or state. In my area, if someone is living in your home, even not paying rent, you must evict them if they don't want to leave. Therefore I would try any way possible (politeness, trickery) to get them out voluntarily. If possible stay nice and helpful. Even offer your help in finding a new place. Its worth it to give them a little financial help if it gets them gone. Make sure they take all their stuff and then change the locks. Don't let them leave anything. That way they can't say they still have any rights there.

If they refuse, you may have to start eviction proceedings. Give them an eviction notice according to your states laws, then if they don't leave, go to the courthouse and sue them. The courthouse has the forms. In my county its $54.00. In a day or 2, the constable goes out and serves them an eviction notice, but they don't have to leave. They can fight it in court where you both will appear in about 10 days. This is in Texas so your area may be different, especially in a city which may have its own regulations. If you have to resort to court action, got to a website for landlords/tenants rights. This are mostly geared to tenants' rights, but you can find out what to do. The courthouse can also help. Its a civil matter, so police won't help unless things get nasty.

Friendly - ask them to leave

Unfriendly - call the cops and have the person arrested for trespassing

tell them the good will has ran out..... its pay up or get out time now!!

wow..very easily said, but so hard to do.. i would just sit down with that person and say "hey (name) i really wish i could continue to help you out by letting you stay here as long as you need, but my money is getting tight with bills and i don't know what else to do besides ask you to get a job and help me out or....... i'm gonna need you to leave.. i know it's mean sounding, but i have to start looking out for myself.." dont' get to much into detail, but you can use your money situation and not being able to have a life of your own... just sound caring and tell them you can't do this anymore, you can barely support your self anymore.. good luck and very best wishes!

explain to them you are tired of continually supporting them & they are not willing to contribute to the household therefore you not going to contribute to them any longer & tell them you want them out......& don't feel bad about it....those who won't help themselves cause their own problems.

All landlord tenant laws that I've looked at provide protections to persons that are in tenancy. These tenancies can occur through a written agreement, by verbal permission, or by refusal to leave.
When a person without a written agreement is living in a property that is being rented by someone else under a rental or verbal agreement they are effectively the tenant of the renter unless the written agreement the tenant has prohibits additional occupants to occupy the property (in that case you can both be evicted by the landlord). In either case the renter must provide the tenant being asked to vacate with the proper written notice to vacate, as required in your state's landlord tenant act, since they are considered either month to month tenants or tenants holding over without permission.
You might want to go to http://www.realestateformnm.com/researchindividual.aspx and research the landlord tenant links on your state in that page.
I wish you luck

I don't know the answer, but I would recommend going into your local Citizen's Advice Bureau, who can give you free legal advice on this sort of thing. I've had a look on their website, but it doesn't seem to be covered there.

You're in a difficult situation. I suppose the only thing you can do is ask a mate to pretend they're moving in and to come to your house one day/night with a suitcase. Then tell that good for nothing he/she has to go. I went through the same situation and starving him out didn't work. He left after we had an argument, slept two nights in his car in the Winter. Might be the same person cos he does it to everybody.

If this person has never paid you rent then you are not obligated to them legally so ask them to leave if they refuse you can use minimal force to remove them you can change your locks when they go out and leave their stuff outside or you could call the police to escort them from your house, the choice is yours.

Ask politely, with a deadline. If that doesn't work, you might have to either call the police to have them evicted, or see an attorney, depending on laws in your location.

janus911
ask them nicely and then bug them constantly to leave.

the law is that even if they didn't pay rent...you are obligated to give the tenant a written and verbal 30 days notice...if they did not move out by then, then you are allowed to call the police.

If you still have keys to enter the house, then use them, call a locksmith and change the locks(obviousely when he is out!).Bag up all his possesions and put them somewhere dry and secure outside(maybe garden shed/garage?.)Then call him and tell him where they are and give him 2 weeks to collect them or they will be disposed of.I do'nt go along with all this shilly shallying and being kind to people who have taken advantage of your kindness for so long.Do'nt feel guilty.it is your home and you owe him nothing.

I'm sure even with the good-will, you expected them to find a place soon enough. They just haven't done this? Just tell them it's time. You would like to have your house back.

Entice them out with the offer of a free drink, pack their bags and slam the door in their face. Or just say nicely you need a bit of space or you are going to decorate or someone else is coming to stay and needs their space. or give them a weekly invoice for all their accomodation, food and other bills etc.

oneieros2002
there is no easy way to do it. the thing is, you have to deal with your own guilt after you chuck this person out the door. you opened your home to a friend who has subsequently abused your hospitality. past experience tells me that ultimatums don't work. if you say something like, "you have 2 weeks to find new living space" or something about rent, then you're giving him/her a loop-hole to weasel thru. I've been in a similar situation, so I know how difficult it is. all you can do is take a deep breath, channel your "inner bee-otch" & show your free-loader the door. no excuses, no trade-offs, no giving in. after you remove your parasite, you find a buddy to distract you from your guilty conscience with some positive re-enforcement. and maybe some tequila shooters. good luck!

Are these your grown children? If so, they will never leave as long as you are cooking, cleaning and paying the bills.
If it's a stranger, give him or her a month's notice or start charging rent. Tell them good will only stretches so far and it doesn't help with the grocery money.

depends on what state ur in. I believe that in california ur gona need a notice to vacate, even tho they dont necessarily live there. hit them wit a 30 day notice. once the month has went by u can call the police and have it enforced. if u wana make sure. call ur local police dept. tell them ur situation. im pretty sure they will tell u want i just did.

Just ask this person to leave. If this person refuses to leave, call the police and have the party arrested for trespassing.

Bag up their clothes, and dump them outside. Call them, and tell them they are evicted.

When they turn up, give them the finger.

It depends on how long they have been there....if they came for the week-end and wont leave, call the cops and have them removed....if you let them move in because they were homeless, you have to give them a 30 day notice to vacate...check it out at the sheriffs department or the local courthouse...i went through the 2nd one...it sucked to serve a 30 day notice to someone I care about but it was the only way to make sure they would move. They weren't paying anything and I couldn't afford to foot the entire bill anymore.

Ask them to leave, if they dont, pack their belongings in those nice black bin bags and turf them out.

I'm in Texas, me friend has had this problem. She had her granddaughter living with her, the granddaughter had her boyfriend stay there for a week and they got into trouble with the police and were arrested. When they got out of jail, she wouldn't let the boyfriend back into apartment. He called the police and told him he had lived there for a month. The police told her, she had to let him in, and her granddaughter could invite anyone she wanted into the apartment, there was nothing she could do. And they could take anything they wanted out of the apartment. The only way she could get them out was to evict them and go to court.
