You can't evict him, you do not own the place and have no rental contract with him for his to have broken. I do not know what planet some of these posters are on.
Legally speaking his rights to the apartment equal yours. You can not legally boot him out any more then he can do the same to you.
Just talk it out with him, I am sure he will leave as he has no way to pay rent.
Also, let the landlord know. If you are on the same rental agreement ask for seperate ones (he can only do this if you are month to month), that way he can legally evict the BF w/o involving you. If you are on the same rental agreement now the landlord has to evict both of you, which you do not want, as it ends up on your credit report. |

talk to the apartment communitys management team and ask if they have a roomate release form. Talk to him about breaking up and try to get him to sign himself off the lease. (thats the roomate release form). |

If you are both on the lease, there is no simple legal way to do it, all you can do is talk to him and explain the situation, and hope he can be reasonable.
Truth is, if he refuses to leave, you can. You have the financial ability to get another apartment, so if it comes down to it, you can move. Explain that to him, because if you do that, odds are he'll end up defaulting on the rent anyway. Maybe he'll be realistic enough to agree to move back home. |

That would depend in large part on who's name is on the lease. If his name is on there also, then you'd need to have a peaceful discussion on why things aren't working out and why you need your space. Make sure you list the benefits of him moving out.
Check the lease and see what your rights are according to the lease. Best of luck! |

it would depend largely on whose name is on the lease. is one of your names on it as primary renter? that's the best place to start.
otherwise, how about talking to him and trying to reason with him about the fact that he's got somewhere to go and you don't. i'd guess you pay the rent if he's not really working. if this is the case, find proof (copies of checks from bank, receipts if you get them, copies of bank transactions:cashier's checks, etc, whatever you use to pay rent). that could help your cause.

Do you have a lease or rental agreement? If not approach the owner and sign one with your name only. Then ask him to leave. Be up front, he maybe thinking the same thing or he maybe hurt but at least he will move on. If he has his name on the apartment then start looking for a new place. With no job he won't be there long. The next time you choose a boyfriend find one that is more equally your match. |

If his name is on the lease / or rental agreement you really can't have him move out. It's up to the person you are renting from to get him out. I know this because I have been there done that. It took allot to get the person out. And even if they are not on the agreement once they get mail sent to your place you have to go to the courts and go about it the legal way ... And in most cases they won't have the person move unless they are not paying rent , or unless there is some sort of abuse taking place and you really need them moved out. It's a long process. Yes, you can easily go to the clerk of court and file for an eviction notice. The law will serve him, and he must move out. It takes about 30 days, so hurry!
