That's a problem, because if the landlord does not do a background check and your husband has a record as a violent felon, the landlord's insurance company is going to get hit for major damages if a claim is made that he attacked a tenantin the building.
The rest of the answer is based on New York law. In other jurisdictions, your mileage will vary.
You could try lying, saying that you are the only tenant. Presumably, it is your income that is going to pay the rent due to husband's record. Now the law says that the tenant has the right to occupy the apartment with his or her immediate family (self, spouse, children, mother, father) plus one more person and the children of that additional person. So you can probably get in, but whether you will hang on after the landlord figures out what is going on is anyone's guess. |

ask around for small mom and pop types that would be willing to look the other way |

keep him out of it and procure the apt for yourself. some times you have to not tell it all. if asked about hubby say you're separated for now until you can come up with a plan B. or you can rent in a 2 family home, private home-owners aren't that strick all the time and if your spouse doesn't plan on going to the slammer again, well maybe the owners will be understanding. |

I have the same problem. Most places want anyone over 18 listed on the lease. All you can really do is not list him and hope you don't get caught really. There are a lot of places that don't do background just a credit but if your luck is like mine your screwed in that area as well. Another problem I had, and Im not sure of your situation, but Im a homemaker so it would be hard to just get a place in my name so I had a cosigner for that. Anyways like I said just sneak him in there (don't think you will get caught unless problems are caused) or find a place that doesn't do it and there are quite a few. Also don't listen to the people that say stupid things on here. What some people fail to realize is that people do stupid things when they are young and they have paid their dues. My hunny got in trouble around 18 I believe and he is a totally different person 7 years later ya know. |

im having a similar problem, i moved because of Hurricane Katrina but i didnt get any FEMA assistant like i was promised i got an apt and used all my savings and in 4 months i had to leave the apt so i have a bad mark on my credit cause of it, try leaving his name of the lease |
