In Texas if you have a proper lease you can file for eviction pretty quick. If they are one day later than the lease allows then you can give three day notice to them. Then you go to the Justice of the Peace. The JP will help you draw up the notice to vacate and give you the other guidelines. I have never seen a lawyer at a JP court and have been there several times. It is not a court of record so a tenant could appeal (I had that happen once) then you would need a lawyer but they normally just get out.

Go to the county courthouse, file the eviction papers via the sheriff and wait the time period by your local laws to dispossess....

Hi,
Go to your local court house and get a copy of an eviction case done by an eviction Lawyer. This will give you a blueprint of how the case goes along with the proper paper work involved. The one piece of advice that we need to follow is.... file for rent escrow paid into court when you file your eviction paperwork. The court will set up a hearing for payment into court. The deadbeat will either comply or move.... simple as that. Once escrow has to be paid into court the deadbeats move because they don't want to pay anyone. Plus the court is now the Landlord once the rent is paid to them. They either get paid or they have the sheriff move the losers. The sad truth is most States have very poor Landlord/Tenant laws and it takes on average three months to evict under ther best of conditions. The Landlords of Vermont are trying to changes these laws so it takes less time to evict deadbeat tenants. We are also trying to change the laws so it becomes a criminal act to with hold rent payments and to destroy property. You can help us change the laws by going to gopetition.com and type Landlord on the quick search line. Our petition will come up....please sign it, and you can use it as a guideline to change the laws where you live too. Let's take back our property rights!

You do not need a lawyer. Go to the clerk of court and file papers. Also ask them what the process includes. It is different in every state. The eviction process does take time but it is easy and inexpensive! Good Luck!

Get a lawyer. It speeds up the propcess and gets them out of your house/apt. The longer is takes, the longer they are living rent free.

It is probably not worth it to try to attempt it without counsel...sure you may try to save yourself a few bucks but they few dollars you will save on bypassing an attorney could come back to haunt you (some areas even make landlords pay for temporary storage of someone's belongings until they find a new home!). The laws vary depending on where you live and dealing with the sheriffs office in a forced eviction scenario may suprise you in that sometimes the protections in place for your tenant are extremely one sided (in a bad way). An initial consult/appointment with a real estate attorney may even be free (worth asking) and you would be suprised at how much they are willing to share for free. Good luck.

Not that difficult. You just need to look up the law in your state concerning eviction proceedings, which these days is available by books, forms, and on the internet.

It will still take time, and will still cost you money in court fees. And if HE has a lawyer, you could be outgunned. Still, if HE could afford a lawyer, then you'd probably be getting paid the rent due to you.

It depends on the laws in your state. I had a renter who hadn't paid in 3 months and wouldn't return my calls. (the property was in another town) When I went to check on the house they had destroyed the place, but had yet to get all of their belongings. I contacted the local sheriff's office to see what I could do. I was able to change the locks and hold their belongings in attempt to recoup the money they owed. In some states once you serve a 30 day eviction notice they have the 30 days to get out or the sheriff can make them get out. In my case they had technically abandoned the property. Call your local law enforcement and see if you can find out what is legal in your area. It's much cheaper than a lawyer visit.

it is easy if they dont pay rent and have been told to leave three months ahead of time. which is a really long time.
If you don't want to go to a lawyer, go to the police department and ask what can be done to peacefully get someone to leave in this situation. They will tell you what you can and cant do upfront.
