CoffeeChic | How do I add my name to my husband's deed of our home? ? |
He bought the house while we were engaged and even though we live in a Community Property State, we would feel better if now my name is on the deed in case of a tragedy or like now when we want to try and refianace our ridiculous mortgage loan. (we got it 12 years ago when it was smart to get an ARM but now we are not financially the same so we need out!) Additional Details Let me edit to add that we are BOTH wanting to know how to do this (not just me, I really don't care, but since I'm the one that makes all the calls and deals with all the paperwork) we both agree that this will make things easier and again in the case of God forbid he passes away.
(Is there anyway besides getting a lawyer to do this? We don't have that kind of extra money right now!) |

Refinance. The mortgage company and the title company that will be involved can accomplish this as part of the process. It will not add much if any cost to the closing.
As you said, since you live in a community property state you are really legal half owner now. I don't know that adding you to the deed would provide any additional protection in case of death but if it makes you feel better then that is worth it. |

You can't put your name on your husband's deed. That's his call. |

The best thing to do would be refinance together. There are mortgage calculators to tell you when and if this would pay off. They let you know the break even point (when the costs of closing equal out the cost of savings on the new loan).

Some of these answers were very ignorant. |

this would depend on timing. if you are refinancing anyways, than i would just refi together and put your name on the deed then. if the refi isn't happening, or isn't happening for a while, you would have to get him to sign you onto the deed. |

Your husband needs to take care of that.
If the house were in your name ....do you think it would be legal for him to call or write and send a copy of marriage license and say Hey....Look I married her put my name on her house. |

consult a lawyer who will correspond with the lending authority to place your name on the deeds |

take your husband and the deed down to a notary public, they will allow you to sign yourself onto it and they'll witness it. |
