alexishart | How do I add my spouse to the deed to our property? |
|
|

HMMMMMM

Depending on the state you should go to a title company or an attorney and explain that you personally wish to quit claim the property to yourself and your wife.
In other words, you need a document that removes your personal ownership and transfers ownership jointly to you and your wife.
However, this may be redundant if your wife occupies the property. In many states, a spouse who lives in a marriage partners property is automatically granted a life estate to the home and may ostensibly veto the sale of the property at their sole discretion. |

A settlement company will do this for a nominal fee. The deed would have to be re-recorded at the courthouse. I don't believe quit claiming is necessary - the spouse can be added as a joint owner by the entirety or any other means of joint ownership.
You know she becomes half owner of the property should you two decide to divorce. |

CAll the settlement company you used for your closing and ask them to rerecord your deed adding your husband. I live in PA and I only have to pay a rerecording fee to be added...It may be different in each state. However you should be able to go to the settlement compnay and they will tell you what you have to do. You can also refinance and add him to the mortgage if you want also....Either way talk with your settlement company ( your broker will know who it was). |

To the question: Simple quitclaim. Just about any title company can help you, or attorney. Many escrow companies will. You can also do it yourself, but given the nature of title documents, if you don't know what to say it can engender a legal battle, so better to spend some money getting ti right in the first place. Make certain of how you want to hold title, and make sure you get it recorded at the county recorder.
To the person who said don't: Depending upon the situation and state law, the spouse likely became 50% owner the second they said "I do." So too late. |

The title company will do it for you and explain the different types of legal ownerships and the different types of deeds. You know the road to H___ is paved with good intentions, therefore I would suggest that you and your husband consider doing a post nuptial agreement addressing the interest of the property in the event of a divorce. Sure would make things a lot easier later. Especially if there are kids involved. |

WHY???.....if you love her, you don't have to do this, if she loves you she does not care, unless you are in a situation with poor health and you want her to keep your house if anything happens to you. just go your local recorders office and they will help you. |

That is easy: have a new deed drawn up adding her to the title. Cost is about $50.00 for an attorney to draft it, and $8.00 to $25.00 to record it, no special thing otherwise to do. |

A Parelegal can help you; it's a form like a Quit Claim Deed.
No need to see an attorney.
Can I ask why you are in a hurry to add your spouse to your property? I'd wait a few years... like at least 10-15... just in case.
If something happens and you get divorced.. he/she instantly gets 1/2 ! |
