How do I deal with a real estate agent who won't return phone calls and fails to show at an open house?
The realtor made beautiful fliers, but it took 4 weeks from the date of the contract to receive them. We also had two scheduled showings, but the interested buyers did not show. We later found out that it was because our lockbox was not working. It is virtully impossible to reach him, and if he does return a call, it is often days later. After he failed to show for an open house, I called to discuss these problems. He suprisingly did not return the calls. I then decided to e-mail a letter telling him that we want to terminate our contract. He promptly e-mailed a nasty note back going off on how we were to blame for these problems and stating that the house will not sell without him. My worries are two-fold: first, he is so angry that I have offended his work ethic, that I don't have any reason to believe things will get better if we stay with him. And the second concern is that if we do terminate the contract, will he try to blackball us and tell other realters untrue things?

You need to have an honest discussion with the Broker in Charge at his office. Show the Broker the e-mails, both the one you sent and the one you got back. Ask to be let out of your contract. Let the Broker know that you have no faith in the agent.

Call his broker. If he's the manager/broker for a company office (like Coldwell Banker or somebody) call their corporate headquarters. If he's independent, call the real estate board. If he's not a realtor (member of the real estate board/association), you may have a problem.

He's forgotten the primary rule of business: The customer is always right. How dare he blame you for him not showing up? What nerve.

Your first concern is valid. He hadn't made good on his promises so far, so why should you expect anything different.

Your second concern though...probably nothing to worry about. There are a lot of other real estate agents* out there who will treat you right. Professionals won't listen to his cr@p and probably already know how he is. Save any paperwork, including emails, in case you need to take legal action or defend yourself against it. You do have a contract, but if the terms are not being met, you have reason to terminate it.

If he's an associate and there's a broker, a simple phone call will probably do a world of good.

*They're agents unless they belong to the local Real Estate Association, then they're Realtors...most people use the terms interchangably, but Realtor is a copyrighted name for members only.

Terminate the agreement. Don't worry about "blackballing". In this market, other agents can't afford to play games.

The real problem is that if you don't properly terminate him he'll come back to you for his commission when your second broker sells the house.

Document all of this and call the sales manager at his brokerage.

Look at your listing agreement. Figure out when you can fire him. Then do it but not a moment sooner.

This is the reason to sign the shortest possible listing agreement.

Report him to his boss! If his boss doesn't fix the problem then tell him that you are going to terminate the contract & all further communications can be made through your lawyer.

You have been mistreated!
I have 39 agents in my office and I would love to hire your agent so I could fire him/her.

Do not waste another minute just send him/her a letter and tell that person to pick up all of his supplies ASAP.

If you get any grief, call his broker and tell him to get the lock box ASAP or you will call the local Real estate Board.

We in the industry will not tolerate your mis treatment.

I didn't read all the answers you got already, so I hope I am not being repetitive, but here is my two cents.

There are too many good Realtors out there to put up with a bad one.

My guess is that he has too many listings to provide decent customer service to you.

Check your contract to make sure there are no early termination clauses that will cause you to pay him a fee. If he does try to enact any charges, call his principal broker and tell them everything that has transpired.

Get a new Realtor that cares about service to their client.

I concur. Call his broker, explain & be able to document dates and facts. This agent is incompetent. Also arrogant without professional results to back it up.

A month to wait for flyers is insane! A faulty lockbox and his failing to show for an open house are NOT your responsibility. They are his.

Unless it is a small town, I doubt any blackballing efforts would yield any results. In this market, any professional real estate agent would love to have a marketable listing.

I did not read the other answers but just in case do this.... call the broker (his boss) and tell them that you want to TERMINATE the listing agreement. If they refuse, call the local board of realtors. Yes, you signed a legally binding contract, but if you have evidence which shows the agent did not do his part of the deal you have every right to end the relationship. The only commission he could be entitle to would be if any buyer who saw the home WHILE he had the listing ended up buying it.

Most likely you can't terminate the listing agreement unilaterally (on your own without his Broker's authorization) so I would take this up with his Broker. The listing is his Broker's, not the agent's. What will probably happen is the Broker will give your listing to another agent in his office who he knows will have a better work ethic.

I don't know why this is a persistent problem in the real estate profession. I've left emails and phone messages for real estate agents in the New Orleans area. To date, ONLY ONE agent has called back. And that's all she did. ONE phone call. She has never contacted me since. If the guys who work under me left my customers hanging, I'd have no choice but to fire them. I'm appalled at how absolutely worthless EVERY REALTOR I've worked with, in the last ten years, operates in such an unprofessional manner. Over 40 phone calls trying to buy a piece of property in New Orleans and nobody can be bothered. If it was up to me, not only would I fire them, I'd yank their license as well. I can't believe these brokers put up with that nonsense. We purchased a building last year for 3.5M, and it took numerous phone calls and no-return phone calls for that to happen. If I owned a company and some twit cost me my commission on 3.5M... yeah, he's SO FIRED, followed by a letter to the real estate commission. I've quit working with agents. I'll make a courtesy call however. The agent gets ONE phone call. If the call isn't returned, I go direct to the owner. When the owner tries to send me back to the agent, I actually *enjoy* telling the owner that I won't do business with their agent/broker, along with the reasons why. Usually pisses the owner off A LOT. So if you're an agent, start returning those calls. I'm not the only one who does this. And it would break our little hearts for you to lose your job.
