You can evict her, but there are many loopholes that can make it a long process.
For this reason, and the fact that she is an unethical and rather creepy person, I suggest that you simply pay an eviction service to handle it for you. It will cost about 600 and they will handle all of the forms, submissions and hearings. |

If it's your home, just tell her she has to leave.
Unless she has signed a lease to live there and is paying rent, she has no choice but to leave if you request it.
If she has signed a lease, just give her a 30-day eviction notice. Search for it on the Internet, or go here: this explains it a little:

I agree that being a disgusting specimen of inhumanity will help illustrate that you prefer living alone.
Step one, since she is not on the lease, she is considered a month to month renter. All you need to do is offer her (in writing!!) one month to catch up on every month she is in arrears or she needs to vacate the premises. Send the notice to pay or quit to the apartment/house via certified mail with return receipt requested. If she returns the envelope, do NOT open it, this will be proof that you tried to notify her of your intentions.
The way it works is you must offer one entire rental period (a calendar month) to catch up on her payments. After she misses the deadline, you can file for eviction with the courts.

Just because she is a real estate agent doesn't make her above the law or above you in owning this property. If there is no signed lease agreement with her and she just won't leave...then call the police....she is trespassing. |

does she have a LEASE ? If not, just kick her sorry butt out. Perhaps, review what the circumstances were when she first moved into YOUR house. If she has NO LEGAL RIGHT to stay, she is EVICTED when you tell her that she is evicted. |

Oh...she is LYING through her teeth.
If her name is not on the mortgage and not on the title, like any other "renter" , she rents, whether she pays money or not.
Think about how idiotic her advice is: Do you think the law recognizes a romantic relationship outside of a legal marriage? Of course they don't. She thinks that she cannot be evicted JUST by living there? Think about it....really, really think about how absurd that is.
Go down to the courthouse and file for a formal eviction.
The police department cannot help b/c she is legally entitled to a 30 day notice and the police dept cannot legally evict someone...a court has to do that.
You are 300% correct...go down and get rid of her.
PS: You CANNOT throw someone out on the street just b/c they don't pay rent...I cannot caution you enough on that and you have received some terrible advice on here...if you do that, then she can SUE YOU for an illegal eviction. She is NOT trespassing.
Remember, RENTAL PAYMENTS are not necessary in order to establish a legal rental agreement.
You cannot charge her for arrears or kick her out for non-payment without a written lease...you do not have to have a legal reason to kick her out...other than the fact you want her gone and you own the home.
Many of the other suggestions will get you arrested.
Go through the proper legal channels. |
