My grandmother passed a year ago. My brother and sister and I were the only living heirs to her estate. The home is still in probate, with me being the legal representative. My brother and his wife, without asking anyone, moved their family into the house. I told them once in writing that they had to move, then in person. My brother is now separated from her and she is refusing to leave. The electric and water are in my name and I have been paying them. She has a satellite dish there and garbage service in her name. How do I get her out, and what are her rights? (Washington state gives 20 days for an eviction but that is for a renter, so I'm not sure) |

Until she is legally divorced from your brother she is not a squatter and not a renter. She is living in property that she partially owns as his wife.
You will not be able to evict her until after the divorce, she has a legal right to live in the house.
Sorry, I know this is not what you want to hear, but her rights to martial property equal your brothers. |

Do the 20 day eviction. At least you have a basis. You do have copies of the letters you wrote and proof of mailing,
certified with confirmation of delivery? Is there an attorney handling the estate? That is who should deal with this. Or look on legal Zoom for paper work to avoid paying an attorney. There are servers that you can hire who physically serve the papers. You should file the papers in court and pay a server to take the eviction.
I am sorry about the loss of your Grandmother and the hassle with your brother's poor choices. Do keep you records as to paying utilities. You may need to sue this woman to get her out.
You may be able to cut the power and water. |

As legal representative, you can hire an attorney to evict them, like you would evict anyone. Because of the probate issue, you should have an attorney for these matters. Have the utilities taken off your name, ask for a final bill. Her rights, she may be entitled to a portion of the proceeds after the sale, even tho she is not married to your brother, she has the children and they can may make a claim. The best advice will come from a housing attorney. Be ready with about 2K to play with, that you can charge back to the estate, upon dissolving the matter. |

If you are the legal rep (executor) of the estate then you should have an attorney, who should be able to advise you on this matter. I would think you should be able to have the sheriff remove her...then you could change the locks, with the bill going to the estate. |

If you have evidence that the home is in your name, or will be in your name you can go to the police to kick them out, or court to get them evicted.
In the mean time I would stop paying the electricity and the water. |

First, start out with cutting off all utilities that are in your name to show that you mean business. Then go down to the city building and obtain an eviction notice. This procedure is a pain and it is not immediate. The city will first serve papers for a notice to appear in court, and it also depends on if the person being evicted appears in court or not. If they do not appear, then an eviction notice is immediately given, however, legally they have up to 90 days to move. If after the 90 days they are not out, you can have them forcibly moved out, where you pay for them to remove all of their belongings from the home and throw it to the curb, but it would be at your expense.
I realize that every state/city/municipality have their own procedures, but the process is more or less along the same lines. |

at a minimum stop paying for the power.
the tenant law thing is a perfect approach
treat her as a tenant who has not paid.
write up a lease she can pay and make it $5,000 a mo. and security
at another $5,000.
if she does not pay, court will require seeing your
trustor papers. IF so, you should be awarded
a judgment.
if you do get one, and she does not pay--
[or you can just say "notice to vacate."
no lease is being made available to you.
That is the 30 day notice.
in that case, you go to court and she has to prove she
has a legal right to be there and if your paper shows you
are the trustor, she should be told to leave.
if she does not , then you seek an unlawful detainer which you
take to the sheriff who will remove her physically.

Wait until after they leave the house to run errands and have the locks changed. When they come back...call the cops and let them know that she has no legal claim to the house. If she doesn't leave, have her arrested for trespassing. |
