Any attorney should be able to draw one up. Just make sure it's notarized.

Most stationery stores sell blanks and you can find them on line. You may also have one prepared by an attorney. Keep in mind that if you are on the mortgage note, a quick claim deed will not release you from the liability of that debt. Your son would need to refinance in order to remove your name from the loan.

Be aware that if you are on the title and you change it from you to your son, you will no longer have title even if you use a Quit Claim deed. If you are merely looking for a deed form go to www.realestateformnm.com they have hundreds of forms and will have the deed you need.

You need to explain your situation better. Are you wanitng to get your name off of the deed? Your sons name on? Basically it sounds as though you are letting your son "rent" the home from you. If some one else, say a non family member was living there, and paying the mortgage payment, it would be considered a rental proerty..... I just need more info...

You can get a blank quit claim deed form at any business/office supply store. They are pretty easy to fill out. It's been a while since I've needed one, but from what I recall, it's not hard to fill out.

There are quit claim deeds all over, stationary stores, staples, office depot as well as online.

As I understand it your son lives with you and make the mortgage payments each month. Also I assume that he is not on the mortgage.

Why do you want to add his name to the deed? You lose control of your property that way. I have heard of nightmares where the parents added children to the property, then wanted to do something with the property, but had to get the childs approval since they are now on the property.

They will tell you that oh don't worry about it add my name to the deed things will be alright, but if for some reason you wanted to refinace, you would have to get your son's permission.

Then there are the tax consequences that arise from added your son by Quit claim deed that are not there using a trust.

If you want to ensure that your son get the property in the event that something happens to you, but you still want to control the property, get yourself a revocable living trust and make him the trustee.

You may have to get a par-legal to prepare one or an attorney, they normally cost about $350-$500 to prepare. If you went to a title company to get your quit claim deed recorded properly it would cost about $200 so add another $100 to it and do it so you will still have control of the property. In the event that something does happen to you this method will prevent your son from going through probate, but it will leave you in complete control of your property.

Careful! You're about to incur some taxes. That is considered a gift, and if over $11,000 an excess gift tax will apply. You can gift a portion annually to your son and if married your wife may do a like gift. If your son is married, you both may gift to them both up to $44,000.00 annually w/o tax consequences. See an estate attorney for assistance. Alternately an accountant can lay it out but then again you'll need an attorney for the legals,

Best to have an attorney or title company prepare the quit claim deed. If you make a mistake you will possibly have to go to court to un-do the mistake and suffer greater expense than it would have cost to do it right up front.

There is a saying that doctors should not treat themselves. That is wise for other applications as well when you lack the expertise to do the job. It is then a professional is the least cost to you.

You do not need a Quit Claim Deed unless there is someone else on the deed. If your son is on the deed and paying the mortgage you might have a hard time getting him to agree to leave an investment he’s been paying for. But, to answer your question, the other person has to agree to “quit his claim”, hence Quit Claim, to the property. Call your local real estate lawyer or title insurance company. They can help you through it.

I would go to the title insurance company, they should have one and may even help you with filling it out.
Do keep in mind that if your name is on the mortgage too you are still liable for that loan. You may want to reconsider taking your name off the title of the house if this is the case. Basically you will be responsible for a mortgage on a piece of property that you do not own. If anything were to happen to your son (God forbid) you would have to make the payments but would not be able to sell the house. It could get really complicated.
