How do I get my deposit back?
I'm living in the UK, renting a place and may soon need to leave because I think the Lanlord intends to sell.
The problem is the estate agent that arranged the contract between me and the landlord has gone bust and they have my month's deposit according to the landlord.
Could my Landlord be lying and should I try to claim from him?
If he's telling the truth how can I get the money back from the busted estate agent?
The estate agent were called Homecrest Residential if that helps.

I would consult the CAB, we rented our house through an agent and they passed on the bond to the landlord when the initial rental period ended.

Check your tenancy agreement to see if the deposit was refundable upon your lease termination, or if it was in lieu of the first months rent. IIf the contract shows that the agreement is between you and landlord then he is responsible for reimbursing you the deposit. If he still continues with the tale of the estate agent having the money advise him you are taking legal advice (Citizens advice bureau or your local authority advisors on private lets). He will probably then cough up.

I would go to citizens advice if I were you, they will give you free advice on this as I am not sure where you stand legally on this. Hunt out your old contract and read the small print asap. Good luck! x

Well i just tried to get onto their website...

but it came up with cannot find... It looks as if they may have gone down the drain... There should be some sort of announcement in the papers regarding bankruptcy and who to contact...

Somebody is fibbing. The agent should have received a cut like a non-refundable portion of the deposit for his work. It all should really be stated in your lease. Look for the fine print.

Best to try to get everyone in one place at one time.

That way when they try to B.S. you - you can call them on it right then.

the deposit should be in the tenants deposit scheme implemented by the Govt...contact citizens advice coz if the agent did not put the money in there your landlord definately has it..and this is illegal as of April 2007...also contact the estate agents obudsman........someone is lying to you

That agent should have deposited that money in a trust account of that agents broker. Call the broker. that money must be in an account. If the broker gives you the run around, threaten litigation, and tell them that you are going to seek legal council.

Do you have a tenancy agreement? If so and it is with the landlord rather than the agency, then he is responsible for everything detailed within that contract. That will include the fact that he has to return a deposit. It may be worth taking all your paperwork to the Citizens Advice and clarifying it with them. I think you need more specific advice here so try CAB. And if the landlord is responsible and you cant get your dosh - take him to small claims court.

Your depost will be with the estate agent,,as you are now a creditor of that company (ie you have a claim against them) you should contact your local council or a solicitor to lodge your claim,,and quick as they usually give any money the company has/had to registered companies first and the people like yourself the least,,,
